THE FIGHT AGAINST DAC8 BEGAN IN FRANCE.
IT IS NOW SPREADING ACROSS EUROPE.
Bull Bitcoin opened the first front in France, where it is challenging the decree that transposes DAC8 into French law before the Conseil d’État, the country’s highest administrative court, and asking for the directive itself to be referred to the EU Court of Justice.
@nprofile…xr4p has now opened the second front in Austria: at its initiative, attorney Dr. Oliver Völkel (CERHA HEMPEL) has filed a complaint with the Austrian Data Protection Authority.
The case is set to go through the Federal Administrative Court to the Constitutional Court, and from there potentially to the EU Court of Justice, the same road that brought down EU data retention in 2014.
As a non-profit association backed by local industry actors, Bitcoin Austria puts its time, effort, and reputation on the line for every Bitcoin (and crypto) user in Europe. This work deserves the respect of the entire industry.
Because DAC8 has been transposed in all 27 Member States, it can be challenged in every one of them, and with two fronts now open, 25 remain.

Some of you know I’ve toyed recently with the idea of changing the focus of my account to other topics or other types of content, but I’ve decided that it’s best to just hang up this identity for now and focus on other things. I have some personal projects and creative endeavors outside of Nostr that are going well and deserve my full time and attention, and I am choosing to give them that. Perhaps at some point those projects can find their way here, if and when it makes sense to put the time into creating here.

A while ago, I was unexpectedly contacted by one of the world’s top advertising creatives (who is also a bitcoiner).
He shared his #1 adoption concern:
Retail’s lack of interest in Bitcoin.
"They think they know what Bitcoin is, and based on that, they're not interested"
What he said next floored me.
“I’m in a unique position of both caring deeply about bitcoin and working with advertising at the highest international level.
And I don’t see a better story to open people’s minds about Bitcoin than the methane story. Nothing is even close”
“If we want retail to give Bitcoin a second look, we need to hook them with something unexpected.
The methane story is it. It's surprising, hope-inspiring and no other single sentence about Bitcoin has the same punch”
He proposed that we shine a light of truth in the darkness: A full page ad in the New York Times.
The ad could create enough of a stir to get this message on some big podcasts and other broad media outside Bitcoin-land
(with a little help from his PR colleagues).
So he orange-pilled a colleague, and they made this ad for us, free of charge.
Imagine opening the NYT and seeing this truthbomb!
The NYT print edition has over 500,000 subscribers, many of which are very influential.
So the ad can make a real difference for how Bitcoin is perceived. And it can accelerate our goal to make Bitcoin mining carbon-negative.
One more thing:
Most people still think Bitcoin = crypto
(no surprise they're not interested in BTC!)
Repeating "Bitcoin not crypto" doesn't change that.
But of the world's top cryptos, only Bitcoin mitigates methane.
This ad shows a huge audience that Bitcoin ≠ crypto.
A version of this ad has already run on Instagram, where it outperformed every other post on that account, including the lighter and funnier ones

A Justiça mudou as regras para o bloqueio de dinheiro em contas de clientes com dívidas no Nubank, Itaú, Caixa Econômica Federal e Banco do Brasil. Com a atualização, os bancos poderão receber e cumprir determinações judiciais com maior rapidez, permitindo que valores disponíveis sejam localizados e bloqueados ainda no mesmo dia.
A medida faz parte de uma modernização dos procedimentos utilizados pelos tribunais para encontrar recursos financeiros de pessoas e empresas que possuem processos de cobrança. A proposta busca reduzir o tempo de resposta dos bancos e tornar mais eficiente o cumprimento das decisões judiciais.
Entre as novidades está a possibilidade de enviar ordens de bloqueio duas vezes ao dia. Além disso, uma nova ferramenta poderá permitir que a Justiça continue procurando dinheiro nas contas de devedores durante um período de até 12 meses.
Inicialmente, as mudanças envolvem cinco grandes instituições financeiras: Nubank, Itaú, Caixa Econômica Federal, Banco do Brasil e XP Investimentos. O Conselho Nacional de Justiça (CNJ) selecionou essas empresas para participar da fase de testes das novas regras.

## **Justiça altera regras para bloquear dinheiro em contas bancárias**
As alterações fazem parte da atualização do Sistema de Busca de Ativos do Poder Judiciário (Sisbajud), ferramenta que permite aos juízes identificar e bloquear recursos financeiros de pessoas físicas e empresas.
O Conselho Nacional de Justiça coordena a modernização do sistema, que funciona como uma conexão eletrônica entre os tribunais e as instituições financeiras, conforme apurado pelo Portal **[Tempo](https://www.portaltemponovo.com.br) [Novo](https://instagram.com/jornaltemponovo)**.

A intenção é garantir que as novas regras funcionem de maneira adequada quando outras instituições financeiras começarem a utilizá-las.
## **Quem tem dívidas pode ter a conta bloqueada pela Justiça?**
Nem toda dívida permite o bloqueio imediato de uma conta bancária. Mesmo com as mudanças, o procedimento continua exigindo uma determinação judicial.
Por exemplo, um consumidor pode atrasar o pagamento do cartão de crédito, deixar de pagar um empréstimo ou acumular parcelas vencidas de um financiamento.
Nessas situações, o credor poderá tentar recuperar o dinheiro por meio de negociações e medidas de cobrança previstas na legislação.
Se a disputa chegar à Justiça e houver fundamento legal para a medida, o magistrado poderá autorizar a localização e o bloqueio de recursos financeiros.
Somente após essa decisão o Sisbajud encaminhará a determinação às instituições financeiras.
Portanto, Nubank, Itaú, Caixa e Banco do Brasil não recebem autorização para bloquear o saldo de qualquer cliente simplesmente porque ele está inadimplente.
A modernização altera principalmente a velocidade e a forma de cumprimento das ordens judiciais, sem eliminar a necessidade de decisão de um juiz.
## **Justiça poderá procurar dinheiro nas contas por até 12 meses**
Uma das principais novidades previstas para o Sisbajud envolve a ampliação do período de busca por recursos financeiros.
O novo modelo contempla uma funcionalidade de bloqueio permanente, que poderá manter determinadas ordens ativas durante até um ano.
O objetivo é permitir que o sistema continue identificando valores disponíveis mesmo quando a primeira consulta não encontrar dinheiro suficiente para cumprir a determinação judicial.
Imagine, por exemplo, que uma pessoa responda a um processo no qual o magistrado autorize o bloqueio de R$ 15 mil.
Se o sistema localizar apenas R$ 2 mil nas contas do devedor, a nova ferramenta poderá continuar procurando o restante do dinheiro durante o período autorizado.
Assim, caso novos valores sejam depositados posteriormente, o sistema poderá identificá-los e realizar bloqueios adicionais, respeitando o limite estabelecido pela Justiça.
Isso não significa que todos os recursos do cliente ficarão indisponíveis durante 12 meses. A ferramenta deverá respeitar o valor da ordem e as proteções previstas na legislação.
Essa modalidade ainda está em fase de homologação e testes. Portanto, o bloqueio permanente por até um ano não funciona de maneira generalizada em todas as instituições financeiras.
## **Como funciona o bloqueio de uma conta bancária?**
O bloqueio judicial começa com uma decisão do magistrado responsável pelo processo.
Depois de autorizar a medida, o juiz utiliza o Sisbajud para encaminhar a solicitação às instituições financeiras.
Os bancos consultam seus sistemas e procuram contas, aplicações e outros ativos associados ao CPF ou CNPJ informado.
Quando encontram recursos que podem atender à determinação, as instituições tornam os valores indisponíveis até o limite autorizado.
Por exemplo, se o magistrado ordenar o bloqueio de R$ 8 mil e o cliente possuir R$ 20 mil disponíveis em uma conta, a instituição deverá observar o limite de R$ 8 mil previsto na decisão.
O banco não poderá utilizar essa ordem para bloquear indiscriminadamente todo o saldo restante.
Depois da localização dos recursos, o processo continua sob responsabilidade da Justiça.
O juiz poderá manter a indisponibilidade do dinheiro, determinar sua transferência para uma conta judicial ou autorizar a liberação dos valores, conforme as circunstâncias.
## **Justiça também pode encontrar dinheiro em investimentos**
As determinações realizadas pelo Sisbajud não se limitam às contas-correntes utilizadas pelos consumidores no dia a dia.
Dependendo do conteúdo da decisão judicial, o sistema também permite localizar outros recursos financeiros vinculados ao devedor.
Isso inclui valores mantidos em determinadas aplicações e produtos de investimento, conforme as regras aplicáveis a cada modalidade.
Dessa maneira, a Justiça amplia as possibilidades de encontrar patrimônio financeiro de pessoas e empresas envolvidas em processos.
Entretanto, nem todo dinheiro localizado pode ser penhorado.
A legislação estabelece proteções para determinadas verbas, como salários, aposentadorias e outros recursos que se enquadrem nas hipóteses legais de impenhorabilidade, ressalvadas as exceções previstas em lei.
Caso o bloqueio alcance valores protegidos ou apresente alguma irregularidade, o titular poderá solicitar a liberação por meio do próprio processo judicial.
O magistrado deverá analisar o pedido e decidir se mantém ou desfaz a restrição.
## **Novas regras serão ampliadas para outros bancos**
A modernização do Sisbajud não ficará restrita ao Nubank, Itaú, Caixa, Banco do Brasil e XP Investimentos.
O Conselho Nacional de Justiça estabeleceu um planejamento de implantação gradual, com cronograma previsto de aproximadamente 18 meses para a transição das novas funcionalidades.
Durante esse processo, o órgão acompanhará os resultados da fase inicial e poderá realizar ajustes antes de ampliar as mudanças para outras instituições financeiras.
Enquanto isso, os procedimentos de bloqueio judicial que já funcionam pelo Sisbajud continuam disponíveis normalmente.
A expectativa do CNJ é reduzir o intervalo entre a expedição das decisões e seu cumprimento, além de facilitar a localização de recursos financeiros.
Com isso, clientes que respondem a processos de cobrança poderão ter dinheiro identificado e bloqueado com maior rapidez, sempre mediante determinação judicial e dentro dos limites estabelecidos pela legislação.
