Our first amicus brief in Hecox was filed in 2020. Our first in BPJ was in 2023.
In 2024, we urged the Supreme Court to take on both cases. In 2025, we argued in a substantive brief before the Supreme Court that women and girls have the right to be protected as a discrete sex

From the bill:
"transgender and nonbinary people [...] are especially vulnerable to violence and abuse and are often deprived of gender-affirming resources and health care while detained in jails, prisons [...]"
What about women's right to not be locked in a cell with men?

Can we make the phrase "arrest-onset gender dysphoria" go viral please?
Men are male and it doesn't really matter how deeply they "feel" like women or how long they've felt that way. It's not possible to change sex, and any non-biological definition of womanhood is sexist.
But this pattern does illustrate the way men are exploiting prison policies at the expense of vulnerable women.

Housing incarcerated women with men is a violation of the UN's Nelson Mandela rules on prison management.

On October 28th, [@forest_romm](https://bird.makeup/users/forest_romm ), WDI USA State Contact for MA, testified before the Massachusetts Commission on the Status of Women on the subject of men in women's prisons.
"More than 86% of the women incarcerated at MCI Framingham have survived sexual abuse by men. Now these men, proven dangerous to women and girls, are not only granted intimate access to these incarcerated women, but then also successfully sued the Commonwealth for access to costly surgeries intended to disguise their sex."

“. . . amicus encourages the Court to take one step further and rule that the Equal Protection Clause requires states to offer separate boys’ and girls’ sports teams based on sex.
It does not make sense to treat America’s women and girls differently for the purpose of designating female-only sports and spaces depending on which states they live in. Women and girls in California and Maine are just as entitled to single-sex sports and spaces as women and girls in West Virginia and Idaho. Title IX and the Equal Protection Clause are, after all, nationwide laws that apply across all fifty states and the District of Columbia. . . .
In these matters, the Court has an opportunity to put this entire discussion to rest. Sex means sex, even if some people claim to have “gender identities” that are somehow inconsistent with their sex. Women and girls are entitled to be acknowledged as a sex class and to single-sex sports and spaces.”

“On September 17, WDI USA filed amicus briefs in the cases of West Virginia v. B.P.J. and Little v. Hecox. In both cases, states had enacted laws protecting female-only sports and male athletes challenged them.”
