The centennial lands on October 31, 2026, the Detroit Historical Museum throws an evening of magic and mystery to mark a hundred years since Harry Houdini died in that city. Appleton, Wisconsin, where the boy Ehrich Weiss grew up, unveils a historical marker in Houdini Plaza the same day. At the Magic Castle in Hollywood, a centennial auction sells off his handcuffs and posters while a members’ séance waits for the night. In New York, thirteen invited guests file into his old townhouse for three closed sittings. Nobody scheduled any of it for October 30. The country knows which date belongs to him.
The calendar runs its own quiet trick. Houdini died on Sunday, October 31, 1926. The famous last séance, the one on the hotel roof in Hollywood, was held on Saturday, October 31, 1936. The hundredth year hands the date back to a Saturday, so the centennial séances will sit down on the same weekday as the original vigil’s final night. Anniversaries are usually arithmetic. This year the calendar cooperated.
[The death record is short and plain](https://bolesblogs.com/2026/07/29/nobody-closed-the-gate-how-traditions-convince-themselves-that-thinking-ended-and-who-collects-the-toll/ ). Harry Houdini died at Grace Hospital in Detroit at twenty-six minutes past one on Sunday afternoon. He was fifty-two years old. The final bulletin from his physicians named “a diffused streptococcic peritonitis, the result of a ruptured appendix.” Surgeons had removed the appendix on October 25, and a second operation later that week bought him nothing. A later generation pinned a room number, 401, onto the story; no surviving record carries one, and the hospital itself was demolished long ago. The entry that holds is plain: a Sunday, a hospital bed, an infection that medicine learned to beat within a generation.
The punches came nine days earlier, in Montreal. On October 22, backstage at the Princess Theatre, several McGill University students came to visit the magician, who was lying on a couch nursing an ankle broken eleven days before in the Chinese Water Torture Cell in Albany. One of them, J. Gordon Whitehead, asked whether Houdini could take punches to the stomach, and then struck him repeatedly before Houdini was prepared. A statement from the family, printed in the Washington Evening Star the day after the death, blamed the blow outright. A McGill professor answered with a denial: “no truth in the Detroit report” of a sparring bout. The doctors of 1926 blamed the trauma. Medical opinion since has split, and the honest modern reading admits the appendix may have been inflamed already, with the punches disguising the warning signs.
He finished the show anyway. In Detroit, on Sunday, October 24, running a fever of 104 degrees, he collapsed when the first-act curtain fell at the Garrick, got back up, and worked the full two and a half hours. He refused the hospital until Bess forced the issue in the early morning hours. Then came the operating table, the daily bulletins, and a week of dying in public while papers across the country carried front-page updates. Kellock’s biography, built from Bess’s own papers, gives his last words to his brother: “I’m tired of fighting.” The body rode home in a private Pullman, laid inside the bronze casket his show had hauled from town to town for the Buried Alive stunt. Bess rode with it. “No one knows what I have lost,” she said.
Two Houdinis worked that final year, and they pulled against each other. The first was the public executioner of spiritualism, who spent his last full season telling every town that the dead do not answer. The second was the engineer of his own return, a husband who left a code in his wife’s keeping and a promise to send it if sending were possible. Same man, same months. Most accounts keep one of them
The first Houdini had been at it for years. In 1924 he published *A Magician Among the Spirits* and put his method on paper: “I have made compacts with fourteen different persons,” he wrote, and none had ever produced a word. He sat on the Scientific American committee whose prize no medium ever collected. His standing offer was ten thousand dollars of his own money to anyone who could show a psychic effect he could not duplicate. At séances he worked in disguise, a reporter and a police officer at his elbows. In Boston he built a restraint box for the medium Margery, and inside it her famous phenomena failed; the committee’s prize went unclaimed. His investigator Rose Mackenberg sat in dark parlors across the country and brought back names, and his own stage show closed with a lecture that named the local operators in whichever town he happened to be playing.
That campaign reached Washington in his final year. Representative Sol Bloom of New York had introduced H.R. 8989, a bill to make anyone “pretending to tell fortunes for reward” in the District of Columbia a disorderly person, punishable by a $250 fine or six months in jail. The Subcommittee on Judiciary of the House Committee on the District of Columbia held four days of hearings: February 26, then May 18, 20, and 21. Houdini took the witness chair as a volunteer, at his own expense, as he reminded the room more than once. He brandished a sealed telegram and dared the packed room of mediums to read it; none would. Representative Frank Reid of Illinois volunteered a guess, and when Houdini told him a guess was no clairvoyance, Reid answered that yes, he was a clairvoyant. The astrologer Marcia Champney hinted at clients in high places, and the Coolidge White House put out a denial. Houdini called the trade’s practitioners “deliberate cheats and frauds,” and the New York Times reported that the May 18 session came near winding up in a fistfight, with cries of “liar” and the committee demanding police. The bill died with the Congress.
The second Houdini was quieter. Years before, when Harry and Bess worked a mind-reading act in the dime museums, they had built a spoken code: ten ordinary words standing for digits, the digits counting into the alphabet. Rosabelle was the song Bess was singing at Coney Island in 1894 when they met. She was eighteen. He was twenty. The word was engraved inside her wedding ring. The agreed message joined them: “Rosabelle, answer, tell, pray answer, look, tell, answer answer, tell.” Run the key and it spells “believe.” Bess put the pact in the plainest terms for reporters: “We did not believe in spirits but had open minds.” In the hospital on the last Sunday, he renewed the standing promise between them. If there was any way back, he would take it.
A controlled test of survival needs four things: a signal fixed in advance, a receiver able to verify it, a deadline, and a defense against fraud. Houdini spent the twenties building all four. The signal was the code. The receiver was the one woman who knew what Rosabelle meant. His defense was his own working life, forty years of knowing every method by which such a message could be faked. The deadline he left to Bess, and she set it at ten years. None of this required him to die on schedule, and every witness says he fought hard against dying. The design required only that when death came, whenever it came, the experiment would already be armed. He made his own death the one escape he could not work, and he arranged for the attempt to be tested under conditions he himself would have called fair.
The familiar account gives her a séance every Halloween for ten years, a candle by the photograph, a widow at a table. The surviving paper record is thinner and stranger. Documented sittings in New York turn up in spring months, and the specialists who keep the Houdini chronology suspect the ten-year frame was assembled for the final event, as theater. I believe the widow more than the calendar. She tested, medium after medium, year after year. The reward stayed posted. A small light burned in the shrine beside his portrait. The Halloween frame may be showmanship laid over grief.
One apparent hit came in January 1929, and it failed the control. Arthur Ford, a medium whose spirit guide called himself Fletcher, delivered the ten words in order to Bess, who was ill and bandaged from a New Year’s fall down a flight of stairs. She signed a statement that the message was “the message we agreed on.” Two days later, officials of the magazine offering the prize money pointed out that the code had been in print for a year, on page 119 of Kellock’s authorized biography, which anyone could buy. The New York Evening Graphic went further and called the sitting a hoax arranged between widow and medium. Bess withdrew her statement. Whatever Ford heard or did not hear, the experiment’s only positive reading was contaminated at the source.
Then came the last Halloween, and she held it in front of everyone. On Saturday, October 31, 1936, some three hundred guests holding golden invitations climbed to the roof of the Knickerbocker Hotel on Ivar Street in Hollywood. Bleachers held the press and radio men worked the crowd. Twenty other séances ran that same night across North America and Europe. The table carried the instruments of the trade: a spirit trumpet, slates and chalk, a small bell, and the famous Mirror Handcuffs interlocked with another pair, the hardware of the old pact. Above it all stood the shrine, his portrait under a red light tended for ten years. Edward Saint, her manager, opened with “Pomp and Circumstance,” Houdini’s own walk-on music. He invoked for more than an hour, begging Houdini to spell out the code or move the table; at one point he asked the spirit for the location of a locked vault that nobody has found to this day. During a lull, one paper noted, a saxophone came sobbing up from the street below. At last Saint turned to the widow. The zero hour had passed. The ten years were up.
Bess gave the finding. She was sixty years old. “Houdini did not come through,” she said. After faithfully following the ten-year compact, after using every type of medium and séance, she had reached her conclusion: spirit communication in any form was impossible, and she did not believe ghosts or spirits exist. Then she closed the doors of the shrine, and the red light that had burned for ten years went out. “It is finished,” she said. “Good night, Harry.” The memory the witnesses kept was weather: out of a clear California sky, a short hard rain drenched the roof and stopped. William Larsen Sr., the magic magazine editor who sat in the inner circle, wondered about that rain for the rest of his life, and he noted that the papers never mentioned it.
That roof was a publication event. Saint had opened the night by announcing that its findings would be publicly recorded, and they were: the script of the evening survives in the Library of Congress. Bess had run her husband’s experiment, held it to its deadline, and reported the null. The negative answer was the one Houdini had predicted in 1924, when he counted his fourteen compacts and admitted none had produced a word. Her finding closed the file he left open. It did not close the door she had watched for ten years. Other people kept knocking at it anyway.
[The séances never stopped](https://bolesblogs.com/2026/07/09/the-seance-court-original-intent-and-the-fraud-of-speaking-for-the-dead/ ); they only lost their sanction. What was meant to end the practice started an industry, and every Halloween since, somewhere, a circle forms around a pair of handcuffs and asks for Harry. This centennial week it happens at the Magic Castle, at the old house in New York, and in theaters and museums from Calgary to Amsterdam. The Society of American Magicians still sends a delegation to Machpelah Cemetery in Queens, where he was buried on November 4, 1926, to break a wand over the grave. Bess lived until February 1943. The sentence the record keeps for her comes from a late interview: “Ten years is long enough to wait for any man.”
The experiment was honestly built, which is why its answer still stands. Houdini designed the test so that even his own return would have to clear it, and nothing has cleared it yet. On Saturday the circles will form again, and someone will ask the empty room for a sign. The terms were published a century ago and they have not changed. The candle stays out.

The first student was a girl from Omaha named Katie Callahan. She came through the door of a school building on Twenty-Second Street, between St. Mary and Leavenworth, on April 1, 1869, and Nebraska began teaching its deaf children. The legislature had voted the school into existence two years earlier, and the man in charge of it was a deaf man. Principal William DeCoursey French ran the Nebraska School for the Deaf alongside a minister named Henry W. Kuhns, and the medium of instruction was sign language. A deaf child could walk in and see a deaf adult in charge, and most such children had never seen that before. Forty-two years later, the same state made that language illegal in the school’s classrooms.
The school moved out of town in 1871. The new campus covered twenty-three acres at what is now 45th Street and Bedford Avenue, four miles from downtown Omaha and a mile north of Benson. A 1914 photograph shows streetcar tracks running past the gate. An 1877 insurance map of the grounds calls the place the Nebraska State Deaf and Mute Asylum, which is what the era called such schools. The name has not aged well. The work inside was humane. Parents brought their children from farms and railroad towns and drove home without them. Most of those families could not talk with their deaf child at all. On that campus, isolated children found each other, sometimes for the first time in their lives. The National Park Service’s history of the campus says it plainly: the schools were where deaf people became Deaf, a culture with a capital letter.
The school inherited its method. The first permanent school for deaf children in America opened in Hartford, Connecticut, on April 15, 1817, built by a hearing minister named Thomas Hopkins Gallaudet and a deaf French teacher named Laurent Clerc. Its first registered student was nine-year-old Alice Cogswell. Sign language was the founding medium of American deaf education, and Nebraska’s school ran on the inheritance. It taught signs and fingerspelling alongside written English, and it added the practical shops of its century, printing and the trades, so that graduates could make a living. School officials called this the combined method, sign and speech together. Nebraska held that middle ground for four decades, while the country changed its mind.
The attack came from Europe in 1880. The International Congress on the Education of the Deaf, meeting in Milan, voted to banish sign language from deaf schools in favor of speech and lip-reading alone. That same year, deaf leaders founded the National Association of the Deaf in Cincinnati to defend the language; it is now the oldest continuously operating civil rights organization in the country. The oralists’ champion was Alexander Graham Bell. He funded the association lobbying for speech teaching, and in 1883 he presented to the National Academy of Sciences a memoir on the formation of “a deaf variety of the human race.” Bell was not a stranger to deaf people. His mother was deaf, and so was his wife. He still warned against deaf people marrying one another. Grant the oralists their decent motive. They believed speech could admit a deaf child to the hearing world, and for a few children, with the right residual hearing and the right teacher, it did. What the record cannot carry is their certainty. Lip-reading yields fragments at best, because most English sounds share their mouth shapes with other sounds. The method was a bet placed by adults on a child’s mind, and most children lost.
Nebraska’s turn came with a bill number. On February 1, 1911, Senate File 173 was introduced in Lincoln. It directed that deaf students be taught by the “oral, aural, and lip-reading method to the exclusion of the deaf alphabet and sign language.” The students protested, calling the bill a threat to their “educational welfare,” and reaffirmed that they preferred the combined method. Deaf adults across the state and the country warned against an “unwise law.” The legislature passed it anyway, and Governor Chester Aldrich signed it in May 1911. Nebraska had company. By the turn of the century roughly 40 percent of American deaf schools had banned signs, and after the First World War the figure approached 80 percent. The wave broke over 45th Street with all the rest.
Superintendent Frank Booth wrote about the language that year. “That language is not now used in the school-room and I hope to do away with its use outside the school-room.” A school founded by a deaf principal now had a superintendent on record saying the children’s language had been driven from the classroom, and hoping to drive it from the dormitory too. That was the content of oralist law: a teacher’s moving mouth at the front of the room, week after week, and discipline for the hands. A deaf child in that classroom watches the mouth all morning and guesses. Nationally, deaf teachers were pushed out of deaf education, and hearing teachers who could not sign were hired in their place. The Park Service’s account is blunt about results. A few deaf individuals succeeded under oralism. The vast majority met frustration and repeated failure.
The law failed the way such laws do. It reached the classroom. It never reached the dormitory or the basketball practice. Students and sympathetic faculty kept signing in the hallways and on the grounds. The Park Service history says the campus’s deaf adults made the resistance deliberate: they ran the athletics and the clubs where the language could live in the open. A thirteen-year-old in that school learned lessons no syllabus carried. She learned where the state ended. She learned that her teachers’ mouths belonged to Lincoln and her hands belonged to her. The children kept the language alive for sixty-six years, in the spaces the law could not see.
Then there is the team. In 1931, twenty years into the ban, the boys of the Nebraska School for the Deaf won the Class A state basketball championship. No deaf school in the country had taken an all-classes title before, and they did it coached by one of the school’s own graduates. The plays came in sign, because sign was the language of that gym whatever Lincoln said. The opponents came from hearing schools across the state. The state that had outlawed their conversation handed them the championship. The historical marker on the campus today lists that team among the school’s achievements. The marker does not mention the language of the huddle. Every huddle that season ran in the banned language.
The law’s premise collapsed in 1960. The office was at Gallaudet College in Washington, and the man was a young English professor named William Stokoe, trained on Chaucer. He looked at his deaf students’ hands and published a paper called *Sign Language Structure*. It found phonology and grammar: a full natural language, rule-bound and analyzable, no more a pantomime than French is. The faculty around him scoffed. Deaf people themselves had been taught to be ashamed, and some laughed at the project. In 1965 Stokoe and two deaf colleagues, Dorothy Casterline and Carl Croneberg, published *A Dictionary of American Sign Language on Linguistic Principles*. Nebraska had banned a language for half a century by then, on the theory that it was a crutch. Linguistics had ruled otherwise. The law stayed on the books anyway.
The school let sign back into its classrooms in the fall of 1970, without anyone calling it a correction. The legislature repealed the ban in March 1977. For the first time since 1911, the school on 45th Street could teach in sign with the law’s blessing. The dormitory children of the thirties were middle-aged by then.
My own cards go on the table here. American Sign Language is my second language. I write books in English, and I am native in both, but sign is the one that lives in my hands; my books are in my fingers. When I read Senate File 173’s clause, “to the exclusion of the deaf alphabet and sign language,” I read a sentence passed on [my wife and co-author, Janna Sweenie](https://bolesbooks.com/authors/janna-sweenie.html ). When I read Superintendent Booth’s hope, my hands tighten and her hope loosens. The repeal came in our lifetime. I grew up in Lincoln, an hour down the interstate from that campus, and nothing in my schooling mentioned that the state had once made the Deaf language illegal in a school full of children whose first language was my wife’s. I learned it from the record. The anger comes second. First you count the years, and you realize that children who grew up under that law are alive now, members of the alumni association that keeps the school’s museum.
The second killing was gentler. It came from Washington in 1975, as the Education for All Handicapped Children Act, Public Law 94-142, ordering public schools to educate children with disabilities and sending federal money with the order. Districts across Nebraska opened their own deaf programs, and the state school began to empty. Grant mainstreaming its truth. No family should be forced to board a six-year-old hours from home. Institutional life carries institutional sins, and a deaf child in a hometown classroom is a civil right the old system never offered. The school’s own people knew the trade was hard. A teacher named George Propp studied the school’s finances in the 1970s and predicted the squeeze. Deaf education, he wrote, would require “a massive application of the resources that exist, as well as the development of technology that lies beyond our present dreams.” He was right, and the squeeze came on schedule.
The numbers after that tell their own story. The community keeps them. The alumni count the arc this way: nearly two hundred students in 1979, thirty-two at the end. The state’s marker rounds it off: enrollment declined, and the school closed with fewer than forty. In 1984 the Department of Education first moved to close the school, and Nebraska’s deaf community fought the attempt off, mapping strategy at the Omaha Association of the Deaf hall. In 1986, by the community’s account, the department added a rule requiring state approval before any district could place a child at the school, and the denials accumulated. Per-pupil cost climbed as the dorms emptied, and the climbing cost became the case against the school, a case the emptying had written.
The end took fourteen years. The alumni association led the defense, joined by deaf advocacy organizations at every level, and a massive rally in 1998 made the case one last time. The legislature moved anyway, citing enrollment and cost, and voted the school closed. The last day was June 5, 1998. The marker does the arithmetic: a hundred twenty-nine years, more than two thousand students. For thirteen decades the campus at 45th and Bedford was the one address in Nebraska where a deaf child was ordinary. After that June day, the state had no such address. It does not have one now.
A network of regional programs replaced the school. Deaf children would be served in their home districts, with interpreters and itinerant teachers, and Nebraska would pay tuition and board at out-of-state residential schools for the children who still needed one. That system runs today, and its strangest feature is the map.
The Iowa School for the Deaf sits in Council Bluffs, just across the Missouri River from Omaha. Since 1998 it has admitted Nebraska’s deaf students, because Nebraska no longer has a school of its own. The terms are public. For fiscal year 2009 the state paid $68,759 per Nebraska student, $42,252 of it for education and $26,507 for board, and in the years after 2006 the Nebraska head count averaged twelve to fifteen. So the state closed a school to save money, sold its twenty-three acres to a private religious foundation for $2.5 million, and now buys the same service at retail, by the head, across the river. A deaf child from Omaha who needs a residential school still gets one. It is just in Iowa.
The deeper ledger is the children. Some mainstreamed deaf students thrive. One careful five-year study of deaf students in general-education classrooms found many of them achieving at average levels or better. The long record, though, is brutal, and it predates the closure. In 2000 the *Journal of Deaf Studies and Deaf Education* published Carol Bloomquist Traxler’s national norming study of deaf students on the Stanford Achievement Test. The median deaf student left high school reading at about the fourth-grade level. About one in ten read above the eighth-grade level. In 2016 a study of students in an ASL-English bilingual program found that children highly proficient in sign answered roughly 40 percent of English reading questions correctly, against 10 percent for their less fluent peers. Researchers now have a name for the mechanism. In 2017 a team writing in the *Maternal and Child Health Journal* defined language deprivation syndrome, the damage done when a child spends the brain’s first five years without full access to any language, spoken or signed. More than 90 percent of deaf children are born to hearing parents, and most of those parents never become fluent signers. A residential school was the one guarantee that such a child would meet a full language on arrival. The mainstream classroom guarantees an interpreter, one pair of hands, while the rest of the room talks past her. She laughs a beat late at the joke. She makes friends with the interpreter.
The skeptic gets a paragraph here. The old schools were institutions, with an institution’s cold corners; the alumni who loved the place will describe its hard edges too. Inclusion is a real right, and some of its children are doing well. The economics were real as well. A state cannot run a residential school for thirty-two students at a defensible cost per head. All of that can be true at once, and the totals still come out bad. Nebraska banned the children’s language, spent sixty-six years failing to kill it, closed the school that sheltered it, and bought the service back by the head across the river, while the median deaf graduate read at the fourth-grade level. That ledger does not balance.
The campus survived the school. The buildings still stand at 45th and Bedford, the Collegiate Gothic classroom block of 1928, designed by Leo A. Daly, and the gymnasium with its swimming pool. The alumni opened a museum in the administration building in 2001, and it keeps four period rooms, including a 1930s classroom and a 1970s dorm room. The association still gathers there. On June 10, 2019, the National Register of Historic Places listed the whole campus as a historic district. The state’s marker went up in 2012. It says the true things in bronze, including the 1911 ban.
[American Sign Language](https://bolesblogs.com/2026/05/25/the-golden-age-of-deafness-1991-tanya-towers-and-the-long-erosion-after/ ) now ranks third among languages studied at American colleges. The Modern Language Association counted 107,899 enrollments in its fall 2021 census, ahead of Japanese and German. The school is closed and the ban is repealed. The language the law aimed at is doing fine. The marker stands in the grass at 45th and Bedford with the old classroom building behind it, and it names the ban and the closing date in bronze. What bronze cannot show is a dormitory door in 1930 and a thirteen-year-old with his hands moving fast, talking in the banned language, the one the state spent sixty-six years trying to catch. It never did. That boy’s classmates are old now, and they still sign.

The scene sits about ten minutes into *The French Connection*. Buddy Russo has been stabbed, and on the way out of the station Popeye Doyle tells him what the wound means. The exchange is short. Doyle calls Russo a dumb guinea. Russo asks how he was supposed to know the man had a knife. Doyle answers with the word that settles what Doyle is. Russo says the man could have been white. Doyle says, never trust anyone.
The exchange disappeared in the first week of June 2023. Viewers who knew it by heart pressed play on the Criterion Channel and found it gone. The talk had been shortened by seconds, and the seconds removed were the ones that said what Doyle was. The same shortening appeared in the version for rent on Apple TV, and in copies customers had already bought and downloaded, products sold as films and rewritten after the sale. Roy Scheider jumps across the room in the middle of his own scene. Nothing on the screen explains why. The picture won five Academy Awards, including Best Picture.
No warning card preceded the picture. No note followed it. A blogger named Jeffrey Wells posted the discovery on June 5, after subscribers noticed the seam, and reporters spent the week confirming what the audience had caught. The altered master had been circulating for months. It had screened at the American Cinematheque’s Aero Theatre on May 12. Viewers comparing recordings found the cut in Turner Classic Movies airings from months earlier, with none of the modified-for-television cards broadcasters once used. It sat in the libraries of people who believed they owned it.
Censorship is the wrong word for this. Censorship announces itself; it wants the audience to know. What happened to Doyle’s exchange is something else. The copies of old films that reach us now arrive cleaner and brighter than the sources they replace, graded to a bluer sky and scrubbed of the grain that was the film’s skin. Sometimes they arrive shorter. Restoration has crossed into forgery, and the copy passes inspection because it looks like care.
I first asked the question here in November 2013. [The essay was called ](https://bolesblogs.com/2013/11/22/coloring-history-should-facts-remain-black-and-white/ )*Coloring History*, and its worry was the quotation: whether a fact should be allowed to keep its black and white, and who touched the words between the speaker’s mouth and the page. The image needs the same accounting now. The law of evidence already has the words for it.
Federal courts ask a modest thing of any exhibit. Rule 901 of the Federal Rules of Evidence requires the proponent to produce “evidence sufficient to support a finding that the item is what the proponent claims it is.” For a physical exhibit the instrument is the chain of custody. Everyone who touches the thing signs for it, and a gap in the signatures goes to the weight the jury gives it. Nobody signs for a film.
The country argued this out in the open forty years ago. In August 1985, Ted Turner agreed to buy MGM/UA for a billion and a half dollars. The deal closed in March 1986, and Turner kept the vault: the MGM pictures made before May of that year and the RKO catalogue that held *Citizen Kane*, with the older Warner Bros. library thrown in.
Turner began coloring the black-and-white stock. By February 1989 his company had colorized some forty pictures, *Casablanca* and *The Maltese Falcon* among them, and it announced plans for four hundred more at a pace of up to three dozen a year. When the tinted *Casablanca* reached cable in November 1988, Roger Ebert wrote that the broadcast would stand as “one of the saddest days in the history of the movies,” proof that no classic was safe from what he called the vulgarity of computerized graffiti gangs.
Orson Welles was dying when the fight reached him. He was seventy. In late September 1985, about two weeks before his death on October 10, he asked the filmmaker Henry Jaglom to protect *Kane*. “I want you to make sure you stop Ted Turner from coloring my movie with his crayons,” Jaglom remembered Welles saying. The second sentence turned out to be right: “Once they start with a Laurel and Hardy short, there’s no reason that they’ll draw the line anywhere.”
That quotation has its own chain of custody. The words survive because Jaglom carried them out of the room. He repeated them to reporters in February 1989, while Turner weighed coloring *Kane*, and Harlan Lebo printed them the next year in his fiftieth-anniversary album of the film. No tape of the conversation has surfaced. The line is testimony: one witness, close to the source, staking his name in front of people who could have contradicted him. No one did.
The crayons did reach *Kane*. Test footage was made, and about a minute of tinted *Kane* survives in a BBC documentary from 1991. The full job never happened. On February 14, 1989, Turner Entertainment announced it would not colorize the picture, and the company insisted aesthetics had nothing to do with the decision.
Lawyers had read Welles’s 1940 contract with RKO. Roger Mayer, Turner Entertainment’s president, reported the verdict: “Under this particular contract, we think our rights are questionable.” The contract, Mayer said, was unusual in its breadth and in its specificity about creative control; it gave Welles command through the final cut, and its provisions “could be read to prohibit colorization without permission of the Welles estate.” The Directors Guild took the win and named its limit in the same breath. “There are only a few directors who have these kinds of contracts,” said Elliot Silverstein, who led the Guild’s campaign.
Jaglom promised to find the contract. He never found it. Turner’s own lawyers had it. The film survived on paperwork and luck.
Washington had already heard the argument. On May 12, 1987, at the Guild’s request, a Senate subcommittee took testimony on colorization. Woody Allen, Milos Forman, Sydney Pollack, and Ginger Rogers spoke against it. John Huston, dead by the end of that summer, sent a videotaped statement. The next day Richard Gephardt introduced the Film Integrity Act, which would have required the written consent of a picture’s principal director and screenwriter for any material alteration, a right of consent meant to outlive the copyright itself. The bill died in subcommittee. James Stewart wrote to Congress protesting the coloring of *It’s a Wonderful Life* and later lobbied in person, arguing that the tint violated what Frank Capra had made.
Congress passed the National Film Preservation Act on September 27, 1988. It created the National Film Registry, twenty-five pictures a year judged, in the statute’s words, “culturally, historically, or aesthetically significant.” And it required any registry film distributed in a materially altered or colorized form to carry a label: “It has been altered without the participation of the principal director, screenwriter, and other creators of the original film.” Willful violations could bring fines up to ten thousand dollars. *Citizen Kane* and *Casablanca* were in the first class, named in 1989.
Even that statute had an escape hatch. Material alteration meant colorization and other fundamental changes made for marketing. The customary practices of preparing a film for broadcast were exempt, the pan-and-scan reframing and the time squeezes that television had always done. The law named the big outrage and let the daily ones continue as custom.
The label law had a three-year life. Congress reauthorized the act in 1992 and struck the labeling requirement entirely. The House report said the labels “did not meet the concerns of filmmakers, scholars, or the public.” I find the reason worse than the repeal. The one law that ever made an alteration identify itself died because the concerned parties found it useless, and the concerned parties were the ones doing the altering.
The Copyright Office acted before Congress did. It registered colorized versions as derivative works carrying fresh copyright. One law review’s postmortem judged that “the real battle over colorization was probably lost when the Copyright Office decided to register colorized films for copyright protection as derivative works.” With new copyrights available on tinted copies, the colorizers had a business model with a government seal. Washington registered the colored *Asphalt Jungle* on June 20, 1988.
France heard the same case as law. Turner had colorized *The Asphalt Jungle* and licensed it to the French network La Cinq. Huston’s heirs, his children Angelica, Daniel, and Walter, joined by his screenwriter Ben Maddow, sued in Paris. A trial court forbade the broadcast. An appeals court reversed, holding that under American law Turner was the author and the coloring a mere adaptation. La Cinq aired the colored film. Huston had been dead for two years.
The Cour de cassation quashed the ruling on May 28, 1991. The moral right, in the words of the 1957 statute the French courts applied, is perpetual, inalienable, and imprescribable, and it attaches to the person who made the work, whatever a contract or a foreign statute says. On remand, the Versailles court found that colorization “merely consists in modifying the work by adding an element thus far not part of the creator’s aesthetic conception.” It awarded six hundred thousand francs in damages and banned the altered broadcast.
Both victories depended on disclosure. Turner announced his plans in press releases, and the Huston heirs knew what to sue. The viewer in 2023 got no announcement at all.
That war looks quaint now. Everything about it was loud. Turner argued in press releases. The Guild answered in hearings. Coloring a feature cost real money and left fingerprints at every stage. Every change came with a name attached.
The tools changed. Digital grading turned the sky into a dial. Noise reduction treated texture as dirt. Then machine learning made the manufacture of detail cheap, and the fingerprints disappeared. None of this arrives with a press release. It arrives as a service, and the service is called restoration.
Fox released an Ultimate Hunter Edition of *Predator* in 2010. One reviewer called its scrubbing an almost unparalleled use of digital noise reduction. The grain was treated as dirt, and the faces came out waxed, Schwarzenegger’s squad smoothed into gift-shop figures. The eye objects before the reason does: a face moves, and the skin stays still. Fox put the grain back for the 2018 edition. The texture had never been noise. It was the picture.
*The French Connection* had already fought a quieter war. Fox let William Friedkin supervise a new master for the 2009 Blu-ray, and he used the freedom to strip the color out of his own picture and bleed it back in. He was chasing the pastel look of John Huston’s 1956 *Moby Dick*, a Technicolor production processed to resemble colorized black and white. Reviewers described jacked-up contrast and a sickly purple tinge. A director had tinted his own film to look like a colorized movie.
Owen Roizman had shot the picture. He called the result atrocious. Fox quietly reissued the film in 2012, in a Filmmakers Signature Series edition approved by both men, the murk removed. Friedkin insisted the earlier disc had been someone else’s error, though the first disc carried a featurette of him praising the process. Consent complicates the case without changing it. The audience was sold a revision under the title of the original. No one told the buyers of the first disc.
The machine versions arrived in December 2023. *The Abyss*, *True Lies*, and *Aliens* reached 4K then, with discs the following March, and the remasters leaned heavily on what the industry calls AI-assisted noise reduction and upscaling. The models invent. Faces arrive polished and pores resolve into plastic. Detail gets guessed from pictures the films never contained. The process, one home-video writer warned, “does create new data that was not there on the original print.” James Cameron approved the work, and the work was sold as preservation.
The chain itself changed too. A platform now stands between the archive and the screen, and the platform answers to no code of ethics. In April 2020, Disney+ presented *Splash* with Daryl Hannah’s backside painted over by computer-grown hair. A viewer spotted the edit and posted it. The original shot returned in November 2022, as quietly as it had left, when the service added parental locks.
The missing seconds of *The French Connection* remain the clearest case. Nobody has ever claimed them. Suspicion settled on the studio that bought the Fox library in March 2019, though the uncut film playing on that studio’s own service abroad complicated the suspicion. Criterion said nothing on the record. Apple said nothing. The cut was never traced to a hand. Friedkin died that August, two months after the discovery, and the question of his consent was never answered in public. The cut does its work on Doyle. What remains is a rough cop. What was removed is a racist one. The film said what he was, and the copy no longer does.
A viewer who notices gets almost nothing from the law. The label statute is dead. The Visual Artists Rights Act excludes motion pictures. France’s principle holds in France. What governs the stream is a terms-of-service agreement. It promises access. It says nothing about the film.
Restoration is real work. Often it is rescue. Elements shrink and decay; acetate turns to vinegar and color stocks fade on their own schedule, and a transfer that honors the source can take a year of skilled labor by people who love the thing. Grain worship is its own error; not every scratch is sacred. Directors hold claims on their work that a frozen original cannot always honor, and Friedkin’s pastel years show how badly that claim can be exercised, and how quietly reversed. All of that is true. None of it excuses the missing signature.
The profession has already written the rules. The International Federation of Film Archives binds its members to safeguard the integrity of the material in their care against “manipulation, mutilation, falsification or censorship.” It requires restorers to “endeavour only to complete what is incomplete and to remove the accretions of time, wear and misinformation.” And it requires that “the nature and rationale of any debatable decision” be recorded and made available to any audience or researcher who asks. That is a custody standard. The archives wrote it for themselves. No one has ever made the merchants follow it.
None of the repairs is exotic. Every release sold under a film’s title should publish its provenance: what elements were scanned and what was done to them, who supervised the work and who signed it. Boutique labels already print transfer notes; the discipline exists. Every release should carry a fingerprint. Since 2017, the federal rules have let certified electronic records authenticate themselves, hash values and all. The same checksum that moves a master through a platform’s ingest pipe would let a buyer check whether the file matches the name on it.
The label should come back, and it should name the act. The 1988 statute covered twenty-five films a year; the principle should cover every commercial presentation, and it should say what was done. Regraded. Denoised. Upscaled by machine. Abridged. A platform that swaps a master should log the swap the way an evidence clerk logs a transfer, and a copy sold to a customer should not be rewritten afterward.
The objections are predictable. Owners will say the audience does not care, and the answer is that no one can consent to what they cannot see. Platforms will say the masters arrive as delivered, which is where the custody breaks. Directors will claim the work as theirs; the Friedkin disc shows what that costs when it happens without a label.
Welles’s crayons were visible. A viewer could see the tint from the back row and name the man holding the box. The new crayon is software, and it signs nothing. *Kane* survived because a 1940 contract did by accident what Congress refused to do by law. Doyle’s seconds survived, where they survived, because a blogger happened to be watching. None of this was design. The next film may have neither a contract nor a blogger.
A master of *The French Connection* sits on a server somewhere with a seam near the ten-minute mark. Roy Scheider crosses that room without moving, and the film goes on without its seconds. Someone made that cut. Someone loaded that master. No law asked for a name, and no name has ever been offered. I keep waiting for it anyway.

The answer came thirteen months after the election, in the December 2001 issue of the American Political Science Review. Six political scientists, led by Jonathan Wand, had spent the year inside the precinct returns of Palm Beach County, Florida. Their title surrendered the suspense: “The Butterfly Did It.” The butterfly ballot used in the county on November 7, 2000, had caused more than 2,000 Democratic voters to vote by mistake for Pat Buchanan, the Reform Party candidate. [Florida had certified George W. Bush the winner by 537 votes](https://bolesblogs.com/2026/04/13/carceral-nation-twenty-years-from-blog-post-to-book/ ), 2,912,790 to 2,912,253. A page layout had moved nearly four times the number of votes that decided the presidency.
Palm Beach County voted on punch cards. The ten presidential candidates were printed on two facing pages, and the column of punch holes ran down the middle like a spine. George W. Bush headed the left page and matched the first hole. Pat Buchanan headed the right page and matched the second hole. Al Gore, second down the left page, matched the third. A voter who read the left column top to bottom, found Gore’s name second, and punched the second hole voted for Buchanan. The eye travels left to right. The holes run straight down.
The county’s absentee voters gave the study its control. Absentee ballots did not use the butterfly format. On election-day ballots, Buchanan’s share of the Palm Beach vote ran four times his share on absentee ballots. In every other Florida county, his election-day and absentee shares matched. Among the 3,053 American counties where Buchanan appeared on the ballot, Palm Beach produced the most anomalous excess of votes for him. Same county, same day.
The Senate race measured the mistake. Among Palm Beach voters who backed the Democratic Senate candidate, Bill Nelson, about ten of every thousand election-day voters also punched Buchanan. Among Nelson’s absentee supporters, the figure was fewer than two of every thousand. Take the absentee rate as Buchanan’s sincere support, and about 2,300 Palm Beach voters appear to have chosen him by mistake. Nearly 90 percent of those absentee Nelson voters wanted Gore for president, so at least 2,000 of the misvotes were meant for him.
Buchanan’s own campaign read the returns the same way. Two days after the election, his sister and campaign manager, Bay Buchanan, told the Los Angeles Times she was startled to hear Karl Rove claim strong Reform support in the county. The Reform campaign had bought no advertisements there and paid no visits. Buchanan received 3,407 votes in Palm Beach County, 0.79 percent of its presidential vote, against 0.3 percent statewide. Richard Smith, a statistician at the University of North Carolina, later modeled the county from the other sixty-six and predicted Buchanan would draw about 371 votes there. He drew nine times that many.
The overvotes came from the same confusion. Palm Beach County threw out 19,120 presidential ballots punched for more than one candidate. An overvote cannot be recounted. It is thrown away. The Palm Beach Post examined the discards and found 5,330 voters, many in Democratic strongholds, who had punched both Gore and Buchanan, whose hole sat directly above Gore’s on the card. Some of them plainly believed that president and vice president had to be punched separately: the second hole for Gore, the third for Lieberman. The card recorded Buchanan and Gore, and the machine refused it. The Washington Post later found that the 8,000 Palm Beach voters who paired Gore with one of the minor candidates printed beside him went more than ten to one Democratic in the Senate race. Statewide, the Post counted 5,800 ballots punched for both Bush and Gore, a population ten times the certified margin. These were comprehension failures, recorded and discarded.
Theresa LePore designed the butterfly ballot. She was Palm Beach County’s elected supervisor of elections, a Democrat, and a member of a federal task force for blind and handicapped voters. She knew her elderly electorate. She enlarged the candidates’ names so older eyes could read them, and the larger type forced the ten-candidate race onto two pages. “I was trying to make the ballot so that it would be easier for the voters to read,” she told ABC News that December, “which is why we went to the two-page, now known as the butterfly ballot.” The first complaints reached her office at ten o’clock on election morning, three hours after the polls opened, from two elderly men. Two days later she told the Palm Beach Post, “Hindsight is 20-20, but I’ll never do it again.”
Instructions were printed on the card. Punch cards had served the county for years. Voters demanded a new election almost at once, and eleven groups of them sued. A circuit judge ruled on November 20, 2000, that no revote was legally possible in a presidential election. The Florida Supreme Court then held that the ballot did not depart far enough from the statute book to void the election. All of it was legal. It still cost 2,000 people their vote. Florida’s legislature answered the following spring with a reform law that retired the punch cards and began putting ballot layouts into administrative rule.
A margin of 537 votes has a hundred fathers, and serious people name the others: the felon purge and the absentee envelopes, the Nader votes and the networks. All of them belong in the record. Only one of them was printed on paper and handed to every voter in the county. Only one of them was designed.
A ballot is a sort of theatrical script. Every voter performs it alone, in a booth, in one take, with no rehearsal and no stage manager. Its stage directions are printed in agate type, five and a half points, the size newspapers reserve for stock tables and legal notices, the size chosen when no one expects the reader. Vote for one. Follow the arrow. The hand holding the pen trusts the page. When the page lies, the hand lies, and the voter goes home believing the performance succeeded.
Palm Beach gave a bad stage direction. It told the eye to travel down the left column, and it told the stylus to punch straight down, and thousands of bodies obeyed both at once. The theater gives an actor weeks of rehearsal and a stage manager with a book. The polling place gives a voter a pen. The voters performed the blocking they were given, and the blocking was wrong.
No one person designs an American ballot. The Presidential Commission on Election Administration counted roughly 8,000 local jurisdictions running American elections. In each one the ballot is laid out by an elected supervisor, a county clerk, a staff of a dozen, or a vendor’s template. States legislate the furniture. Florida’s section 101.151 awards first position in every race to the party that won the last governor’s election, which is why Bush’s name stood first in 2000: his brother had won the statehouse two years earlier. The statute fixes the order of the names and the headings of the offices. Then it falls silent about everything the eye actually meets: columns, arrows, shading, breaks.
The federal government only advises. The Help America Vote Act of 2002 created the Election Assistance Commission, and in 2005 the commission hired the design initiative Design for Democracy to draft model ballots and voter materials. The resulting handbook says on its face that compliance is voluntary, and that where the guidance conflicts with state law, the law wins. The Center for Civic Design boils the same research into pocket field guides now used in election offices across the country. Volume one covers designing usable ballots. Volume three covers testing ballots for usability, which means watching ordinary voters work the draft before it prints. The guides rest on one sentence, and it has never been made law. Thousands of votes are lost in elections every year because of poorly designed ballots.
The federal guidelines now describe the butterfly’s mistake. The Voluntary Voting System Guidelines require that a certified system be able to present a contest without splitting it across two columns or two pages. Their drafters cite strong evidence from recent elections that split contests produce overvotes and misvotes. The requirement travels with machines submitted for certification. States adopt the guidelines by choice, and no statute obliges a county to rehearse its ballot on a single voter before election day.
Florida taught the lesson more than once. Duval County lost more votes that same November: nearly 22,000 presidential ballots spoiled as overvotes, more than Palm Beach threw out, in a county where the presidential race ran onto a second page.
Sarasota County came next, in 2006. In the race for Florida’s 13th Congressional District, Republican Vern Buchanan, no relation to Pat, defeated Democrat Christine Jennings by 369 votes. More than 18,000 Sarasota ballots recorded no choice in that race, an undervote of 12.9 percent, while the Senate race on the same ballot drew an undervote of about 1 percent. The county had placed the two-candidate congressional race on the same touch screen as the six-candidate race for governor, and voters’ eyes went to the big race. The supervisor, Kathy Dent, told the Sarasota Herald-Tribune that people missed it because it was sandwiched between two big races. The newspaper’s own analysis concluded that the most important factor in the undervote was bad ballot design. Michael Herron, one of the six authors of the butterfly study, testified that with a normal undervote Jennings would have won by roughly 3,000 votes. Investigators examined the machines for more than a year and cleared them. The layout was no one’s responsibility.
Broward County repeated the mistake in 2018. The county printed its instructions in English, Spanish, and Creole down the first column. The Senate race went beneath them, at the bottom left. The governor’s race opened the second column and collected the eye. Some 30,413 Broward ballots, 4.5 percent, skipped the Senate race; in the rest of the state the skip rate was 0.7 percent. Nearly 25,000 fewer Broward votes were cast for Senate than for governor. Rick Scott beat Bill Nelson statewide by 10,033 votes. Researchers at the MIT Election Data and Science Lab priced the layout at a net loss of 9,658 votes for Nelson, which leaves Scott the winner by 375. A later study estimated roughly 25,000 excess undervotes, concentrated among the least informed voters. Florida rewrote its ballot rules the following year and standardized what Broward had improvised.
The order of the names is design too. Florida’s ballot-order statute has been measured in court. In 2019, after a federal trial in Tallahassee, Judge Mark Walker found that the candidate listed first in a Florida office block receives, on average, about five percentage points of primacy advantage. That edge is larger than the margin in much of the state’s modern history. Walker struck the governor’s-party-first statute down. The Eleventh Circuit set his order aside on standing, and the statute stands. In Florida, first position still belongs by law to whichever party last won the governor’s race.
A locked polling place leaves evidence. There are photographs, affidavits, a sheriff’s report, a plaintiff. A bad layout leaves nothing. The ballot was counted exactly as marked. The voter goes home believing she voted for the man she chose, and there is no day in court, because the injury is invisible to the injured. The harm surfaces a year later, as a regression in a journal, as a number in a model. Bad design disenfranchises as surely as a locked door. It is only more polite about it.
No official sets out to confuse anyone. Theresa LePore was trying to help old people read. The injuries fall on the predictable: the elderly voter and the first-time voter, the second-language reader and the worker racing a shift. Every one of them goes home believing the vote counted.
The voter blames herself. Some voters knew at once, and they were the lucky ones. The rest never knew. A voter who caught the mistake at the booth could ask for another card. Once the card was cast, there was nothing to ask for. Shame does not sue. A locked door produces a plaintiff. A bad ballot produces an apology muttered to a poll worker. The poll worker cannot give the vote back.
The midterms fall on Tuesday, November 3. The ballots for that day are being laid out now, in the few crowded weeks between the close of candidate filing and the deadline to mail ballots overseas, by clerks working against printers’ deadlines and vendors’ templates. The sample ballots will run in the newspaper and sit on the county’s website, mostly unread. The fixes are known, and they are cheap. Put the instructions where the eye starts, and keep every contest in a single column. Test the draft on a dozen voters before it prints, and fix what makes them stumble. No statute from Washington requires any of it.
Twenty-six years have passed since that election. The instrument is the same instrument. A presidency once fit inside the distance between a name and a hole. More than 2,000 Palm Beach County voters punched Pat Buchanan’s hole by mistake, and most of them went home believing they had voted for Al Gore. No recount could reach them, because the paper recorded the hand rather than the intention. On the first Tuesday of November, tens of millions of hands will trust the column break and the arrow. Somebody arranges that page. Democracy has a layout.

Sean Dunn walked up to a line of federal agents at the corner of 14th and U Streets Northwest on the night of August 10, 2025. The agents were Customs and Border Protection officers posted outside a nightclub hosting a Latin Night, part of the federal force surging into Washington that weekend. Dunn shouted at them for the better part of seven minutes. He called them fascists and racists. He chanted “Shame.” “Why are you here?” he shouted. “I don’t want you in my city!” Then he threw his dinner at Agent Gregory Lairmore’s chest. The dinner was a Subway footlong, still in its wrapper. Dunn ran. The agents caught him. A body camera recorded what he said on the sidewalk. “I did it. I threw a sandwich. I did it to draw them away from where they were. I succeeded.”
Dunn worked for the Justice Department. He was a paralegal and international affairs specialist in the criminal division. Attorney General Pam Bondi fired him in a social media post and branded him an example of the Deep State. Armed agents in riot gear later raided his home, and the White House posted a produced video of the raid. Jeanine Pirro, the United States attorney in Washington, announced a felony charge under the statute that punishes forcible assault on a federal officer by up to 8 years in prison. Then her prosecutors carried the case into the grand jury room.
[The grand jury said no](https://bolesblogs.com/2026/08/03/swimming-the-author/ ). The joke, forty years old, had met a footlong. Federal grand juries nearly always say yes. United States attorneys prosecuted about 162,000 federal cases in fiscal 2010, and grand juries declined to return an indictment in 11 of them, according to the Bureau of Justice Statistics. That is one refusal in roughly 14,700 cases. The bureau later stopped publishing the refusal count. The worst year for prosecutors in the last decade of published data was 2007, with 23 refusals against 68,413 criminal cases commenced. Pirro’s office withdrew Dunn’s felony and settled for a misdemeanor.
The hearings kept getting shorter. John Coffee of Columbia Law School mined the Justice Department’s annual reports and found that grand juries averaged 126 minutes per case in 1985. The average fell to 60 minutes by 2000 and 54 minutes by 2009. It slid to 30 minutes by 2011 and 24 minutes by 2018. Coffee then subtracted the hours spent swearing witnesses, reading charges, deliberating, and returning indictments in open court. His arithmetic left perhaps ten minutes of live testimony behind each indictment.
The rules of the grand jury room explain the numbers. A federal grand jury seats 16 to 23 citizens and needs only 12 votes to indict. It meets in secret. It hears the government’s side alone, under evidence rules that admit hearsay no trial jury could hear, a practice the Supreme Court approved in 1956 in Costello v. United States. A prosecutor owes the grand jurors no mention of evidence favorable to the target, the Court held in 1992. The standard is probable cause, a fair probability on which reasonable people act.
Sol Wachtler knew the problem from the inside. He had taken office as chief judge of New York’s highest court in January 1985, the same month he told the New York Daily News that the state should scrap grand jury indictments altogether. District attorneys, he said, now had so much influence over grand juries that “by and large” they could get them to “indict a ham sandwich.” The New York Times, summarizing his argument a month later, said grand juries operate more often as the prosecutor’s pawn than the citizen’s shield. Tom Wolfe, a Washington and Lee classmate of the judge, put the line in The Bonfire of the Vanities in 1987, and it entered the language.
A federal grand jury indicted Wachtler himself seven years later. The charges grew out of his harassment of a former lover, Joy Silverman. He resigned from the bench, pleaded guilty, and served 13 months in federal prison and a halfway house. He had once told an etymologist he regretted the ham, since pastrami made the truer New York sandwich. After prison he told an audience that he had always feared the sandwich line would be the only thing anyone remembered about him. Now, he said, he wished it were.
The grand jury began as an instrument of the crown. Henry II’s Assize of Clarendon in 1166 required twelve lawful men of every hundred and four of every village to name, under oath, the neighbors they suspected of robbery, murder, or theft. The neighbors they named went to the ordeal of water. Across five centuries the panel changed sides. London grand jurors refused to indict the Earl of Shaftesbury for treason in 1681 and wrote “ignoramus” across the bill: we do not know. A crowd in the street roared approval. Two New York grand juries declined to indict the printer John Peter Zenger for seditious libel in 1734. The attorney general charged him anyway, by information, and a trial jury set him free in August 1735. The Fifth Amendment made the shield constitutional text in 1791: “No person shall be held to answer for a capital, or otherwise infamous crime, unless on a presentment or indictment of a Grand Jury.”
Modern refusals cluster where the accused wears a badge. The Houston Chronicle found in 2015 that grand juries there had not indicted a city police officer since 2004. Dallas grand juries reviewed 81 police shootings from 2008 through 2012 and indicted one officer. The ham sandwich line got its bitterest workout in the autumn of 2014, when grand juries in Missouri and on Staten Island declined to indict the officers who killed Michael Brown and Eric Garner. The shield had not vanished, the country learned. It had bent toward men in uniform. Every refusal says the same small thing. Twelve citizens in a secret room looked at the government’s case and told it no.
Washington broke that pattern in August 2025. Grand juries in the District refused to indict at least seven times in the first three weeks of the surge, by one count, and three of the refusals landed in a single case. Sidney Reid had filmed an ICE prisoner transfer outside the D.C. Jail in July. Prosecutors said she shoved an FBI agent’s hand into a cement wall hard enough to cut it. The agent’s own text messages labeled the cuts “boo boos” and Reid a “lib tard.” An ICE officer told her during her arrest, “You should have just stayed home and minded your business.” Three grand juries heard the felony case, and three declined it. Prosecutors filed a misdemeanor, produced on the eve of trial two videos the government had said did not exist, and watched a jury acquit Reid on October 16 in under two hours. Grand jurors also refused a felony case against Nathalie Rose Jones, an Indiana woman accused of threatening to kill the president on social media, and a judge dismissed that case outright.
The misdemeanor trial played out over four days in November. Agent Lairmore, a 23-year veteran of Customs and Border Protection, testified that the sandwich struck his ballistic vest hard enough to feel and that it “exploded all over” his uniform. He could smell the onions and the mustard, he said, and an onion string hung from his radio antenna late into the night. The government’s own photograph showed the footlong on the ground, intact in its wrapper. Jurors learned that Lairmore’s colleagues had marked the occasion with gifts, a sandwich-shaped plush toy and a patch that read “Felony Footlong.” Lairmore kept them. The patch went on his lunchbox. The cross-examination drew laughter from the courtroom. Sabrina Shroff, Dunn’s lawyer, told the jury in closing: “A footlong from Subway could not and certainly did not inflict any bodily harm.”
Jonathan Turley called the verdict nullification. The acquittal, the George Washington University law professor wrote that day, “seems more like the result of jury nullification than deliberation.” The elements had all been there. A video shows the throw. Dunn’s own lawyer opened the trial by conceding, “He did it, he threw the sandwich.” The judge called it the simplest case in the world. When twelve citizens acquit on that record, they are voting on something past the evidence. They are voting on the government in their streets. Turley put the objection in its principled form: law enforcement officers, he wrote, are not dunk-tank targets for any citizen with rage issues. He is right about the elements. On the evidence, this was a conviction.
The other reading is older than the republic. The Crown treated what Zenger’s jurors did as lawlessness. Every refusal is a small vote of no confidence, and a republic cannot run on verdicts that ignore evidence. Yet a body that can only say yes adds nothing to prosecution except ceremony. The secrecy that made the room a rubber stamp when prosecutors were trusted also lets it refuse when they are not. Washington’s grand jurors did in August what London’s did in 1681. They looked at the government’s case and declined to put their names on it. Shield and nullification are one act, performed in one room. We name it afterward, by whether we like the defendant it covers.
Pirro blamed the jurors. Grand jurors, she said on Fox News, live in Georgetown or “in some of these better areas,” so “they don’t see the reality of crime.” A prosecutor who cannot persuade twelve randomly drawn neighbors has lost something no charging mill can replace. The city answered her all autumn. Banksy-style portraits of the thrower went up on restaurant walls. Halloween skeletons held footlongs in their bony hands. The trial jury, which ate sandwiches at lunch on its last day, deliberated about seven hours before acquitting Dunn on November 6. Dunn hugged his lawyers when the foreperson read the verdict. Outside, he said he had been trying that night to protect the rights of immigrants. “Every life matters,” he said, “no matter where you came from.” Pirro’s office closed the case with a statement that law enforcement should never face assault, no matter how minor, and that even children know they may not throw things when angry.
The footlong survived the night intact. In the government’s evidence photo it lies on the pavement, still in its wrapper, undamaged by the explosion the agent described. The sandwich held together. The felony did not. Wachtler’s joke outlived its teller because the numbers kept proving it. Washington’s grand jurors spent one August proving that the room can still refuse. The question they left standing is the one the joke always carried inside it. What is a grand jury for, if it never says no?

AOL ended its dial-up internet service on September 30, 2025. The company posted a short notice saying it routinely evaluates its products and had decided to discontinue dial-up, and that [the AOL Dialer software and AOL Shield browser would go with it](https://bolesblogs.com/2009/03/27/att-3g-quicksilver-modem-review/ ). The service had run for over three decades, and it taught America what connecting sounded like. Two sounds went with it: the handshake screech and a recorded voice saying you had mail.
The Census Bureau counted 163,401 American households that used dial-up alone to get online in 2023. That is table B28002 of the American Community Survey, with a margin of error of about 5,900 households, and it works out to just over 0.13 percent of all homes with an internet subscription. People in that count heard the screech the week the notice went up. Some of them heard it on the last night.
The company’s own annual report counted about 26.5 million U.S. subscribers at the end of 2002. Every dial-up session on every one of them began the same way. One phone line served one machine at a time, and a household learned to listen for the hiss before making a call. Every session began with thirty seconds of noise, and everyone in the house knew what the noise meant.
The noise had a grammar. Almost nobody who heard it nightly knew the words. I learned some of the words because of a job. In the [CompuServe years I was Toshiba’s Modems and Communications guy](https://bolesblogs.com/2005/05/29/the-cpm-kaypro-2x/ ), and [my days were built from failed connections](https://bolesbooks.com/win95.html ). Initialization strings. Noisy rural lines. A hotel switchboard that hung up the call at forty seconds could eat a whole afternoon. [When you do that work](https://bolesblogs.com/2005/05/30/toshiba-qosmio-g15-av501/ ), the screech stops being noise. It becomes a transcript, and the whole job was finding where the negotiation broke.
Oona Räisänen published the score for it in 2012. She is a Finnish engineer who writes about radio signals, and she took a recording of a dial-up handshake, made by William Termini on an iMac G3, and turned it into an annotated spectrogram on her site. Time runs left to right, pitch runs bottom to top, loudness shows as brightness. Her labels walk through the picture second by second, and the sound you remember resolves into sentences.
Those first sounds belong to the telephone network itself. The calling modem listens for a dial tone, the same hum you hear when you pick up a landline, and then it dials the number in dual-tone multi-frequency signaling, two pure pitches per digit. Your touch-tone phone used the same code. The modem begins by speaking the network’s oldest language, because nothing data-specific exists until a second machine picks up.
The answering modem speaks first, and its first word is a single long note at 2100 hertz. That note is aimed at the network itself. The telephone system was built around a theory of human conversation: one person talks while the other listens. To keep you from hearing your own voice echo back, the network’s echo suppressors mute the return path while you speak. Modems cannot live with that arrangement, because modems talk at the same time. The 2100-hertz note is the answering machine’s opening demand: switch off the suppressors. Under the standards, the suppressors quit after about 400 milliseconds of the tone.
The note carries a second demand folded inside the first. Every 450 milliseconds the tone snaps 180 degrees out of phase, a click you can hear if you know to listen. Those snaps target the echo cancellers, the newer machinery that subtracts the echo and keeps both directions open. A steady tone defeats one device and leaves the other running, so the modem breaks its own tone, on schedule, until both kinds of equipment stand down. The cancellers are more stubborn; they hold out for a full second of the broken tone before they quit. On Räisänen’s chart the snaps show as thin vertical seams in the band of the note.
The two modems introduce themselves once the network’s echo machinery stands down. They trade short bursts of slow frequency-shift data, 300 bits per second, on two different pitches so each can tell the other’s voice from its own. Räisänen’s labels call this exchange the V.8bis transaction; the V.8 family is the menu protocol. The caller reads out the modulation schemes it can speak: V.34, V.32bis, V.22, the older and slower dialects. The answerer reads back the overlap. Those fuzzy buzzes in the middle of the recording are two machines settling on a shared dialect.
The modems then stop describing themselves and start measuring the line. Under the V.34 standard, each modem sends a comb of test tones, 21 of them spaced 150 hertz apart from 150 hertz to 3,750 hertz, skipping four frequencies reserved for other signals. A short loud burst goes first, then a longer quieter one. Each receiver measures what survived the copper, tone by tone: how much of it came through, and how much noise came with it. The two machines swap their lab results and settle on a speed the wire can carry. These probing tones are the low, mournful boings in the middle of the sound you remember.
The last loud stretch is rehearsal. Each modem sends scrambled data, pseudorandom bits with no pattern, so the receiver can tune its equalizer against the measured line and train its own echo canceller on the real channel. The rushing noise at the end of the handshake is that practice running at full power. Then the calling modem detects carrier, the speaker clicks off, and the session begins. The hiss that stayed on the line for the whole call was data.
None of it needed to be audible. The command ATM0, four characters typed before dialing, turns the speaker off for good. Almost nobody typed it. The factory default did the opposite and kept the speaker live until the connection was established. Räisänen has a theory about why. Telephone lines were audio territory first. The earliest modems were acoustic couplers, and you placed the handset into rubber cups and listened to your own call like any other. A modem that dialed in silence would have felt broken, and an audible handshake let you catch a busy signal or a human voice saying hello in time to pick up and apologize.
The sound had a second use. In the forum I could ask a stranger a thousand miles away what the noise did, and the answer located the failure. Most of them had never once been asked to listen to it. A screech that quit before the boings meant the modems had failed to agree on a language. Boings with no final rush meant the line could not carry the chosen speed, and the fix was to force a slower one. Retrains replayed the back half of the handshake. It was a diagnostic instrument sitting in every den in America, and we treated it as an annoyance.
That audible negotiation was the last one the public got to hear. Every device you own still negotiates each time it joins a network. Your laptop bargains with the router for an address. The phone proves to the access point that it knows the password, without ever saying the password aloud. A browser argues encryption with every site it touches, and the handset asks each cell tower for permission to join. All of it happens silently. The negotiation still happens every time a device joins a network, and it now happens where the people paying for it cannot hear a word.
The silence has taught us to forget that connecting is an agreement. Forgetting has a price. When the terms of a connection become inaudible, they start to feel like weather. Throttling feels like a slow evening. A captive portal presents itself as a door that was always locked. Carrier address sharing passes for the nature of the internet. The modem era made one small correction to that power imbalance: for thirty seconds per session, the bargaining played out loud in the room where the bill was paid. You could hear the other side answer. You could hear when it refused.
The screech said that a machine was asking for something in your name, and here, in plain air, was the other side’s reply. We called it noise. We imitated it as a joke. Quieter modems and faster lines buried the whole arrangement under silence. It was the last time the network showed its work.
The other sound AOL retired had a human being inside it. Elwood Edwards recorded four phrases in his living room in 1989, into a cassette recorder, for $200. He was 39 years old, and the $200 was the whole fee. The phrases were [“Welcome,” “You’ve got mail,” “Files done,” and “Goodbye.”](https://bolesblogs.com/2005/11/10/virtual-relationshaping/ ) His wife worked for the company then, and the company liked his tape and never asked him into a booth. Edwards died on November 5, 2024, one day short of his 75th birthday. The service he greeted outlived him by eleven months, less a week.
A few smaller providers still sell dial-up, so the handshake survives in scattered houses and on farm lines at the far end of the copper. The stage where America learned the sound has gone dark. Räisänen’s poster is a score now: the tones and timings of a performance the network no longer gives for an audience. Almost no line will carry it aloud.
The ritual ran the way it always ran on the last night of September. Dial tone, digits, the long note with its scheduled snaps. The two buzzes, the measured boings, the rush of rehearsal, and then the click of the speaker switching itself off at carrier, exactly as designed. The negotiation closed with its terms accepted. Everyone in the room heard every word of it, the way they always had. The words meant nothing to them, the way they always had. Then it was October. The negotiation kept happening in silence, and nobody was left who remembered that the silence had once been speech.

Barbara Keating was 72 when American Airlines Flight 11 carried her into the North Tower. She had spent the summer on Cape Cod visiting her grandchildren, and she was flying home to Palm Springs. On August 7, 2025, the New York City medical examiner’s office gave her name back. Technicians had identified her from minute remains recovered in the trade center wreckage, matched through advanced DNA testing against a hairbrush from her home and samples from her relatives. Her son Paul told reporters that a scrap of her ATM card was the only other trace of her ever found. She was the 1,652nd person identified among the 2,753 killed at the World Trade Center. Her family has buried her beside her husband.
A hairbrush is a hard object for a hoax theory. It sits in a family’s house for 24 years, and then a laboratory uses it to hand a name back to the dead. No drone, no missile, no planted explosive, no computer-generated victim absorbs that object. The theories that [September 11](https://bolesblogs.com/2002/09/11/thinking-about-september-11-2001-2002/ ) was a hoax have always broken against the same obstacle, and the obstacle is the people. Each theory earns the same test in this article: taken as its own authors wrote it, granted its true parts, weighed against the record. The theories fail the test.
The hoax canon has a known launch date and a known amplifier. Thierry Meyssan’s book arguing that no airliner struck the Pentagon went on sale in France on March 11, 2002, six months after the attacks, and it topped the French bestseller list in six of its first seven weeks. Loose Change, the online film made by 23-year-old Dylan Avery and two friends, followed in April 2005 and became what Vanity Fair later called the first Internet blockbuster. Between those two poles the movement produced books, papers, websites, and lecture tours. It never produced one agreed account of what happened. The theorists split into camps, and the camps contradict one another. The contradictions do more damage to the theory than any official report has.##
The Paper PrecedentThe drone theory has a real ancestor. In March 1962 the Joint Chiefs of Staff signed a memorandum to the Secretary of Defense proposing pretexts the United States could manufacture to justify invading Cuba. The plan was called Operation Northwoods, and it stayed secret for 35 years. The John F. Kennedy Assassination Records Review Board released it in November 1997, and James Bamford’s book Body of Secrets carried it to a wide audience in the spring of 2001, months before the attacks. One proposal in the file had a military aircraft painted to duplicate a civilian airliner and loaded with selected passengers traveling under prepared aliases, while the real airliner became a drone. The passenger plane would drop into an auxiliary field at Eglin Air Force Base to unload everyone. The drone would fly on, radio a Mayday over Cuba, and be destroyed by remote signal.
Northwoods is the strongest card the hoax theorists hold. President Kennedy rejected the plan, no version of it was ever carried out, and the chairman who signed the memo was replaced within the year. The file still deserves to be read, because it shows how professionals once solved the hardest problem. Northwoods carries no real passengers. The people aboard the duplicate flight are operatives under false names, and they walk away at Eglin. The architects of that memo understood what every 9/11 theorist has had to relearn. A faked airliner attack cannot afford actual human beings with names and tickets. On September 11, 2001, more than two hundred passengers and crew had families and dental records. Every drone theory borrows the Northwoods machinery, and every drone theory has nowhere to put the people.##
The Three ExitsThe passenger problem is where the movement splinters. Three exits exist, and each one closes the others. One camp has the passengers murdered by their own government. Another unloads them in Cleveland and relocates them under new identities. A third insists they never existed at all. A theorist’s view of the planes predicts the exit. People who believe the aircraft were drones tend to kill or relocate the passengers, because a substitute plane leaves real people standing around. People who believe there were no planes at all, only doctored television, tend to erase them, because fabricated video implies fabricated victims. The people aboard are the one part of that morning that none of the machinery absorbs.
The murder camp begins with an anonymous informant. In 2002 a writer named Carol Valentine circulated a scenario credited to a source calling himself Snake Plissken. All four flights land at one base, and their passengers are consolidated onto the plane that crashes in Pennsylvania. A. K. Dewdney, a professor emeritus of computer science, expanded the scenario in August 2003 under the name Operation Pearl. His flights land at Harrisburg International Airport. Remote-controlled substitutes strike the towers. The passengers of three flights are loaded onto Flight 93, an Air Force jet shoots it down over Shanksville to eliminate the witnesses, and the three empty Boeings are flown out over the Atlantic after dark and scuttled. His earlier draft, Ghost Riders in the Sky, had killed everyone aboard with a fast-acting nerve agent. His paper closes by naming Israel’s Mossad as the most likely perpetrator.
The murder answer is effective because it keeps the dead dead. That at least fits the grief the country watched. It is not effective because it fails on arithmetic and on bodies. Dewdney asserted that Flight 93 had “just enough seats” for the passengers of all four flights. His own table lists 225 passengers across them, and the 9/11 Commission gives that aircraft’s seating capacity as 182. The Armed Forces DNA Identification Laboratory produced 44 unique DNA profiles from the Somerset County crash site, one for each of the 44 people aboard Flight 93. At the Pentagon, only one Flight 77 passenger, a child, was never identified. In New York, the medical examiner identified Flight 11 flight attendant Karen Ann Martin and passenger Douglas Stone in 2006, and identified Barbara Keating in 2025. The dead were found where Dewdney says they never went.
The second exit is relocation. It grew from a newswire mistake. On the morning of the attacks, the Cincinnati station WCPO posted an Associated Press item saying a Boeing 767 had made an emergency landing in Cleveland and that United had identified it as Flight 93. The station later blamed an error in the wire report that subsequent updates corrected. The jet Cleveland’s mayor described was a 767, Flight 93 was a 757, and the grounded plane was Delta 1989, which had not been hijacked. Loose Change producer Jason Bermas was still telling a Cleveland newspaper in 2006 that United 93 landed safely and was wheeled into a hangar at NASA’s Glenn Research Center. The reporter on that story, James Renner, went to NASA Glenn and learned the mystery aircraft was a KC-135 microgravity research plane whose scientists were driven to a hotel after the airspace closed.
Dean T. Hartwell’s book Planes without Passengers builds the fullest relocation account. The passengers of Flights 11 and 175 board one plane, land in Cleveland, are held at the NASA building, and receive new identities and new homes, with instructions to change their appearance. Some, Hartwell suggests, were blackmailed into cooperating. Barbara Olson, he concludes, survived under a new identity after her husband made a deal, and he raises the possibility that families traded silence for assurances and money. He floats the hypothesis that the Shanksville remains were cremated remains of people who died before 9/11, with matching DNA gathered through a sham casket company. Then, of his central claim that the passengers live among us under other names and under watch, he writes, “I know I cannot prove this last part.” The relocation answer is effective because it spares the believer the ugliest conclusion and gives the passenger question an address. It is not effective because it needs every family to keep the secret, or to be deceived without noticing, for 25 years, while the medical examiner in New York keeps returning Flight 11 remains from the trade center wreckage.
The third exit deletes the passengers entirely. The September Clues website, the work of a writer calling himself Simon Shack, argues that the televised plane strikes were special effects, asks whether the casualty total could be zero, and describes the memorial lists as databases of fictitious identities. Its frequently asked questions page poses the passenger question almost word for word and answers that “none of these people have ever existed.” The site singles out Honor Elizabeth Wainio of Flight 93 as a computer-generated person who never lived. Honor Elizabeth Wainio was 27, and from row 33 at 9:53 that morning she called her stepmother, Esther Heymann. The National Park Service’s list of calls from Flight 93, built from FBI records entered at the 2006 Moussaoui trial, logs that call. Underlying credit card records give each caller’s name, the number dialed, the duration, and the seat row. Wainio stayed on the line for four and a half minutes. Her last words to her stepmother were, “I love you. Goodbye.” The military DNA laboratory identified everyone aboard her flight. Even the theory’s neighbors reject this exit. Mark Conlon, whose own planes-research site carries a section on 3D volumetric holograms, has published a series accusing September Clues of deception.
The call objections deserve a direct answer. The claim that the calls lack engine noise or background chaos rests on far less audio than people assume. Only the first four minutes of flight attendant Betty Ong’s call from Flight 11 were recorded, because of a time limit on a newly installed system, and Amy Sweeney’s twelve-minute call from the same plane was never taped. The 9/11 Commission relied mainly on FBI interviews with the people who received the calls, conducted while memories were fresh. A quiet line proves little where audio does exist. Telephone audio of that era carried a narrow band of frequencies shaped for speech, and a steady hum is the sound that equipment and listeners discount.
The cell phone objection aims at a small target. Thirteen people placed 37 calls from Flight 93, and 35 of those calls went through the seatback Airfones in the last nine rows. Hartwell concedes in one chapter that air phones work at most altitudes and states in another that Boeing 757s had no air phones in 2001. The Commission, citing FBI Airfone records for Flights 93 and 175, describes one in each row on both sides of the aisle, and Flight 93 was a 757. The faked-voice theory leans on a February 1999 Washington Post report that a Los Alamos scientist named George Papcun could clone a voice from about ten minutes of recordings. Papcun demonstrated the technology with scripted lines in the voices of General Carl Steiner and Colin Powell, including a mock statement that Powell was being treated well by his captors. The Loose Change filmmakers believed this software imitated the passengers. A scripted sentence built from archived speeches is one feat. A live conversation with your own spouse, answering questions as they come, repeated by 13 callers on one plane within 35 minutes, is a different order of problem.
The calls matched the physical record. Callers from Flight 93 reported knives, a claimed bomb, and passengers herded to the back of the plane. A hijacker’s voice came over the cockpit voice recorder, speaking as the captain, telling passengers there was a bomb on board. The FBI collected 14 knives or portions of knives at the crash site. The two flight attendants on Flight 11 did work no voice software fakes. Betty Ong gave the ground the hijackers’ seat numbers, and those numbers led investigators to the names. Amy Sweeney stayed on the phone with her colleague Michael Woodward in Boston until the plane was low over Manhattan. Her last reported words were, “I see water. I see buildings. We’re flying low, we’re flying way too low.”
The paperwork is untidy in places, and the theorists mine every seam. Hartwell cites FBI records showing a single unconnected call under Barbara Olson’s name. The Commission’s endnote explains that the records could not show which of four connected calls from Flight 77 to unknown numbers were her two calls to her husband’s office. The FBI and the Justice Department believed all four were hers, and a canvass of every Flight 77 family found only Renee May’s parents and Ted Olson reporting calls. A billing gap on a day of chaos is ordinary. The theory reads it as a confession.
Wallace Miller is the witness the hoax movement cannot explain. He is the Somerset County coroner, and he is also the local funeral director, the man who buries his neighbors. Strangers called his office for years, he told the Cleveland Free Times in 2006, demanding to know why he was covering for the government. His remark about seeing no blood at the crash site had been lifted out of context and circulated as proof that no plane crashed there. His answer stands in the record: “we did ID everyone onboard.” The passengers cannot have died in his field, lived on under new names after Cleveland, and never existed at all. The three exits cancel one another. Each camp handles the contradiction by enlarging the conspiracy until it swallows whoever might testify against it. The people swallowed are real, and their remains, their billing records, and their calls corroborate one another in ways none of the exits can reproduce.##
The Missile That Left Airliner PartsMeyssan’s book supplied the Pentagon cluster its founding claims. No aircraft struck the building. No film of the explosion existed. The photographs showed none of the debris a crash leaves, and the damaged area was too small for a jetliner. His own account shifted as the book sold. He first described a bombing from inside the building, and by June 2002 he was telling interviewers that an Air Force air-to-ground missile had done it. The book passed 200,000 copies even as two French journalists answered it with a rebuttal built partly on interviews with 18 witnesses. Each claim grew from a true seed. Witnesses interviewed later by engineers described fine pieces of wing debris drifting down around them, which reads oddly in early accounts. The Pentagon did refuse for years to release its own security footage.
The missile claim breaks against the engineering record. On the afternoon of the attack, the American Society of Civil Engineers formed a study team led by Paul F. Mlakar of the Army Corps of Engineers. Its January 2003 report drew on NTSB aircraft data, eyewitness interviews, security camera frames, and FBI records of where the dead were found. Frank Probst, a Pentagon renovation staffer, hit the ground as the plane came at him. He watched the right wingtip pass through a portable generator and the right engine tear out a fence, and he saw the left engine strike an external steam vault. Don Mason, stopped in traffic, said the plane passed directly over him and struck three light poles. The measured damage matches their accounts. Severe facade damage ran about 120 feet. The damaged width across the plane’s path measured about 90 feet, because the outer portions of both wings broke away at or just before the wall. The debris path ran about 310 feet through three rings, and the front landing gear and the flight data recorder were found nearly 300 feet inside. Meyssan’s sequel made much of what he called traces of a small circular device passing through three parts of the building. The round hole in the inner wall sits at the end of that debris path, where the landing gear and recorder came to rest.
The missile camp cannot agree on its own weapon. Dewdney allowed for a remote-controlled fighter jet or a cruise missile. Hartwell proposed a missile painted in American Airlines colors, fired as a real airliner swerved away from the building at the last second. Hartwell’s version tells on itself. It concedes what the witnesses saw, a large airliner bearing down on the Pentagon, and then needs a second weapon to make the airliner disappear. The missile idea endures because it matches an intuition: a plane with a 125-foot wingspan should punch a 125-foot silhouette into a wall. The engineers measured the damage instead and found it consistent with a 757 whose outer wings never entered the building.
The engine argument rests on a photograph and a wrong factory. No engine survived intact, and none should have, since the engineers judged that the aircraft disintegrated as it moved through the forest of first-floor columns, its debris moving like an avalanche. The best-known fragment, a disc photographed at the site on September 13, 2001, by a FEMA photographer, became the centerpiece of an article by Christopher Bollyn in American Free Press arguing it could not come from a 757. Bollyn quoted a Rolls-Royce spokesman at the company’s Indianapolis plant who said the part matched no Rolls-Royce engine he knew, then conceded that he does not build engines. The 757’s RB211-535 engines are built in Derby, England. An aviation editor Bollyn consulted said the RB211-535’s inner discs run 29 to 41 inches across and the photographed part could well be one of them. A former cruise-missile engine engineer quoted in the same article said the disc did not come from a cruise-missile engine. People picture an engine as the big pod under the wing and expect to see one lying on the lawn. The theory’s own published experts said the disc could belong to the 757’s engine.
The no-DNA claim is false on the forensic record. William C. Rodriguez III of the Office of the Armed Forces Medical Examiner described the process in the forensic literature. A temporary morgue rose on the Pentagon grounds. Every body or fragment received an evidence number and a helicopter flight to the Dover Air Force Base mortuary. Then came fingerprints, full-body x-rays, dental examination, autopsy, and DNA sampling, with volunteer forensic anthropologists from the Smithsonian Institution assisting. Reference DNA came from immediate family members and from personal effects in the victims’ own homes, hairbrushes and toothbrushes. The laboratory identified every Flight 77 passenger and crew member except one child, and 5 male profiles matching no family reference were attributed to the 5 hijackers. The FBI’s location data, reproduced in the engineering report, adds a grim confirmation. Most passengers’ remains lay near the far end of the debris path, while the remains of the hijacking suspects, who most likely sat near the front, were found close to the point of impact. A missile carries no passengers to scatter in cabin order. Hartwell’s surviving version of the claim holds that no source independent of the government has identified any passenger’s remains. The kernel is true, because military laboratories did the work. A fabrication on that scale would still have had to deceive or enlist every family that supplied a reference sample from its own bathroom shelf.
The video claim holds the most truth in this cluster. The government earned part of the suspicion. For years the Pentagon refused to release its security footage, saying it had been handed to the Justice Department as evidence for criminal proceedings. When the first official footage came out on May 16, 2006, after a Judicial Watch lawsuit, it came from two cameras at a single parking-lot checkpoint. Those cameras were built to record license plates and ran too slowly to capture the approach, so the plane appears as a thin white blur. The engineering numbers show why. The aircraft was moving about 780 feet per second, the frames came roughly one second apart, and the first frame caught the plane about 320 feet from the wall, 0.42 seconds before impact. At that speed a 155-foot airliner travels 5 of its own lengths between frames. Later in 2006 the FBI released the long-sought CITGO gas station tapes, which did not capture the attack, and in December it released grainy rooftop footage from the Doubletree Hotel in Arlington.
The confiscation claim has a court record behind it. The court record narrows the claim. In a Freedom of Information case brought by Scott Bingham, FBI agent Jacqueline Maguire stated in a sworn declaration that she had found 85 videotapes that might be responsive. Of them, 56 showed neither the Pentagon, the crash site, nor the impact. Another 16 showed the building without the crash site or the impact. That left 13 showing the crash site, 12 of them only after impact. One tape showed the impact, and the government produced it. Confiscated is accurate as a verb and misleading as an implication. The bureau collected tapes as evidence on a day when the crash was a crime scene, and the tapes that later came out show what the declaration said they would. A blurry or absent film records camera placement and frame rate. The wreckage, the remains, the flight data recorder, and the witnesses record the aircraft. That recorder, recovered nearly 300 feet inside the building, showed Flight 77 striking the Pentagon at about 530 miles an hour, according to Maguire’s later trial testimony.
Every Pentagon theory ends at the same hole. If a missile hit the building, where did Flight 77 and the 64 people aboard go? Meyssan wrote that the flight vanished from radar and never reached the Pentagon. Dewdney landed it at Harrisburg and moved its passengers onto Flight 93. Hartwell had it take off with no passengers at all. Meanwhile the military laboratory identified the passengers from remains recovered inside the building the missile supposedly struck, using reference samples their families supplied.##
The Sound of a DemolitionThe demolition cluster needs a correction first. Most people frame the debate as fuel against explosives, and that framing misstates the official account. The National Institute of Standards and Technology states that in no instance did it report steel melting in the towers. Its finding is that the impacts severed columns, knocked fireproofing off the floor trusses and columns, and spread jet fuel across several floors. The multi-floor fires that followed, reaching about 1,000 degrees Celsius, weakened the bared steel until floors sagged and pulled the perimeter columns inward. Bare steel at about 1,000 degrees keeps roughly a tenth of its room-temperature strength. The fuel was the match, and the slogan that jet fuel cannot melt steel beams answers an argument no investigator made. Within two days of the attacks, Zdeněk Bažant and Yong Zhou of Northwestern University had an analysis in press at the Journal of Engineering Mechanics. Published in January 2002, it showed that once prolonged heating cost a single floor most of its columns, “the whole tower was doomed.” The structure’s resistance fell about an order of magnitude short of what survival required.
The collapses do not follow a demolition’s script. NIST rejects the demolition hypothesis on two observations. Each collapse began at the floors where the plane struck and the fires burned, and nowhere else. Each began only after a delay, 56 minutes in the South Tower and 102 minutes in the North Tower, set by the impact damage and the time the fires needed to weaken critical members. Video shows both collapses running from the top down. Police and fire department records contain no evidence of blasts below the impact zones as the tops began to move. Once the top sections moved, the arithmetic took over. A typical floor’s connections could carry about 11 additional floors loaded gradually and about 6 loaded suddenly. 12 floors dropped onto the North Tower’s intact structure, and 29 onto the South Tower’s. NIST timed the first exterior panels striking the ground at about 11 seconds for one tower and 9 for the other. Large portions of both cores, roughly 60 stories of one and 40 of the other, stood for 15 to 25 seconds after the collapses began, which sits poorly with charges meant to cut the cores.
The familiar demolition signs each have a measured answer. Jets of dust burst from windows below the collapse front, fitting air compressed ahead of the falling floors. Similar puffs appeared on the fire floors before the collapses, even from the North Tower when the second plane hit the South Tower. A glowing liquid poured from the South Tower’s 80th floor in the minutes before it fell, from the spot where aircraft debris had piled up. NIST attributes it to melted aircraft aluminum mixed with burning office furnishings. Seismic spikes began about 10 seconds after each collapse started, when debris reached the ground, and nothing registered before. On thermite, NIST estimates at least 0.13 pounds of thermite per pound of steel to bring a member to about 700 degrees. That means many thousands of pounds hidden in occupied offices, held against hundreds of massive members, and ignited remotely, in a sequence nobody heard.
The believers hold some real material. Fairness requires listing it. NIST did not test the steel for explosive or thermite residue, arguing that the telltale elements also occur in ordinary building materials, including sulfur in gypsum wallboard. Much of the steel left the site during rescue and recovery before any investigation began. That removal enraged professionals at the time. Bill Manning, the editor in chief of Fire Engineering, wrote in January 2002 that “for more than three months, structural steel from the World Trade Center has been and continues to be cut up and sold for scrap.” He called the official investigation a half-baked farce and demanded that the destruction and removal of evidence stop immediately. A demolition theorist quoting Manning today inherits his anger without his conclusion, since Manning was demanding a real investigation, and he never alleged explosives.
The believers’ signature laboratory claim arrived in April 2009. Niels Harrit, Steven Jones, and seven co-authors reported red-gray chips in World Trade Center dust whose red layer they called unreacted, highly energetic thermitic material, in a paper published by The Open Chemical Physics Journal, a Bentham Open title. The journal’s editor in chief, Marie-Paule Pileni, resigned over its publication, saying the paper had been printed without her knowledge and, in her judgment, should never have been published in that journal. Two months later the same publisher accepted a computer-generated nonsense manuscript submitted as a test by a Cornell graduate student, complete with a fictitious Center for Research in Applied Phrenology, and billed the hoax authors an $800 publication fee. That journal’s editor in chief resigned as well. An independent forensic microscopist, James R. Millette, later analyzed chips from four dust samples collected within a month of the attacks and identified iron oxide pigment particles, kaolin clay plates, and a carbon-based epoxy binder. That is the recipe of primer paint. NIST’s own position is that federal dust studies traced the metals and compounds in question to paint pigments, wallboard, concrete, wiring, and plastics.
Building 7 carries more weight with skeptics. The reason is fair. NIST itself calls it the first known case of a tall building brought down primarily by uncontrolled fire. The 47-story tower was never struck by a plane. Debris from the North Tower, 370 feet away, set fires on at least 10 floors. The fires on floors 7 through 9 and 11 through 13 burned out of control, because the morning’s collapses had broken the city water main feeding the lower floors’ sprinklers. After almost 7 hours, heat expanded the long floor beams on the east side until a girder on Floor 13 lost its connection to Column 79. Floors cascaded down to the fifth, leaving that column unbraced across 9 stories. It buckled, the east penthouse dropped into the building, the core failed from east to west, and the facade came down last, at 5:20:52 in the afternoon. Nobody died in Building 7. About 4,000 people had been inside when the planes struck the towers, and they had hours to walk out. The critical failures occurred below about 400 degrees Celsius, where thermal expansion matters more than lost strength. The fall looked symmetrical because the interior had already failed inside a stiffer exterior frame, and the penthouse dropping first was the visible clue.
The skeptics earned one correction here. It belongs to them. NIST’s August 2008 draft said the north face took 5.4 seconds to drop 18 stories, about 40 percent longer than free fall. Public comments pushed NIST to track a point on the roofline, and the final report identified a middle stage, lasting 2.25 seconds, at gravitational acceleration, which NIST attributes to buckled exterior columns offering negligible support during that interval. On explosives, NIST calculated that the smallest blast able to fail Column 79 would have registered 130 to 140 decibels half a mile away, and no such sound appears on any recording or in witness accounts. Rigging the building would have meant stripping walls, column enclosures, and fireproofing, then torch-cutting steel, unnoticed in an occupied tower. An emergency responder caught inside did report hearing two loud booms. NIST’s answer stands: no reported sound matched the level a column-cutting blast would produce.
The foreknowledge claims point the other way. Fire officials decided to abandon Building 7 nearly three hours before it fell, on a day when 343 New York City firefighters had already died in the towers. The BBC did report the collapse early, at 4:54 in the afternoon against an actual time of 5:20, after CNN had been reporting since about 4:15 that the building was burning and in danger of collapse. The network’s editors later traced the error to a mistaken Reuters report that CNN had also picked up. A warning that a building may fall, passed through enough hands on a chaotic afternoon, becomes a report that it has fallen. Larry Silverstein’s remark about deciding to pull it comes from the PBS documentary America Rebuilds, broadcast in September 2002. His spokesman said in 2005 that the word it referred to the contingent of firefighters inside the building. Even the FAQ page of Architects & Engineers for 9/11 Truth allows that Silverstein may have meant pulling firefighters back from the area.
The skeptics’ most credentialed work deserves a hearing. It also deserves its price tag. In March 2020, Leroy Hulsey of the University of Alaska Fairbanks, with colleagues Feng Xiao and Zhili Quan, issued A Structural Reevaluation of the Collapse of World Trade Center 7. The study concluded that fire did not bring the building down and that the collapse was a near-simultaneous failure of the building’s columns. Architects & Engineers for 9/11 Truth paid for the study, $316,153 by the university’s project accounting, and announced the findings describing itself as representing more than 3,000 architects and engineers. NIST’s record has soft spots that such work exploits. Building 7’s steel was removed before investigators could identify it. NIST withheld some collapse-model files on public-safety grounds, and a federal court upheld the withholding. NIST concedes that its simulation departs from the video in the late stages of the fall.
The demolition case deserves to be weighed whole. It is effective because the collapses looked like demolitions, Building 7 was unprecedented, NIST revised its free-fall account under outside pressure, and evidence went to the scrapyard before anyone could test it. It is not effective because demolition leaves a signature these collapses lack. No recording carries a blast sound. No record shows the wall-stripping and column-cutting that rigging occupied buildings requires. The collapses began where planes struck and fires burned, and the fire department expected Building 7 to fall and pulled its people back hours ahead. The theory asks charges to survive a jet impact and up to 102 minutes of fire before firing on cue. It asks conspirators to rig two towers the planes were already destroying, then wait 7 hours to drop a third building no plane had touched. A real demolition answers with crews, paperwork, and noise. This one answers with silence at 140 decibels.##
The Men Who Claimed ItThe hoax canon also has to dispose of the hijackers. Its favorite exhibit is a mistake the record corrected in public. On September 23, 2001, the BBC reported that several men named by the FBI as hijackers had turned up alive. A Saudi pilot named Waleed Al Shehri protested his innocence from Casablanca, and a Saudi engineer named Abdulaziz Al Omari explained that his passport had been stolen while he studied in Denver. The theory cites that story to this day. What it cannot cite is the ending. The men who came forward were namesakes, sharing common Arabic names with the dead hijackers, and the FBI’s final list settled the identities. In 2006 the bureau gave the BBC its definitive statement: the FBI is confident that it positively identified the 19 hijackers, and neither the 9/11 Commission nor the congressional joint inquiry ever raised doubt about those identities. The BBC’s own editors appended a note to the original article explaining the confusion. The correction never travels as far as the mistake.
The authors of the attacks claimed them, repeatedly and on camera. On October 29, 2004, four days before the American presidential election, Al Jazeera broadcast an 18-minute videotape of Osama bin Laden addressing the citizens of the United States. In it he abandoned his earlier denials, told viewers he had personally directed the 19 hijackers, and described the moment the plan to strike the towers came to him. In a 2006 audiotape he put it flatly: “I am the one in charge of the 19 brothers.” Khalid Sheikh Mohammed, captured in Rawalpindi in 2003, went further before a military tribunal at Guantanamo in March 2007. “I was responsible for the 9/11 operation, from A to Z,” his statement read, and he described himself as the operational director for bin Laden for the organizing, planning, follow-up, and execution of the operation. The hoax theory must make these men liars in the opposite direction, proud killers confessing in detail to a crime the theory insists Americans committed against themselves. It must also make liars of the 19 men who recorded martyrdom videos and then boarded the planes.##
The Question That Ends ItThe movement draws its energy from real grievances. Pretending otherwise only feeds it. The government did hide its Pentagon footage for years. The steel did go to the scrapyard before investigators could test it. NIST did revise its free-fall account only after skeptics pressed. A French bestseller, a viral film, and a thousand websites converted each of those failures of disclosure into evidence of authorship. The conversion was always illegitimate. Secrecy proves secrecy. Incompetence proves incompetence. Neither proves a missile.
The theories’ deeper defect is structural. Every camp survives by enlarging the conspiracy until it swallows whoever might contradict it, and the swallowed are never officials alone. They are coroners and DNA technicians, airline billing clerks and seatback phone records, widows and sons. The murder camp needs a county coroner to lie about identifying his neighbors. Relocation needs thousands of relatives to hold a secret across 25 years of birthdays. Erasure needs Honor Elizabeth Wainio’s stepmother to mourn a daughter who was never born. Meanwhile the camps contradict one another on the only question that matters, and each camp’s answer is another camp’s refutation.
The durable test of any 9/11 theory is the passenger question. Arguing video frames never ends, because every frame becomes a fresh dispute about pixels. Arguing the physics invites a duel of reports, since believers hold the Hulsey study and the Harrit paper against NIST and Bažant. Asking what became of the people aboard the four aircraft forces a choice among murdered, relocated, and invented, and the camps destroy one another. The record answers with remains found in cabin order and 44 profiles from a Somerset County field, with billing records and cockpit tapes that match the calls. The theory answers with a source named Snake Plissken.
[The work continues in a New York laboratory](https://bolesblogs.com/2006/08/07/the-incongruity-of-mourning-and-the-911-memorial/ ). About 40 percent of the trade center dead, more than 1,100 people, remain unidentified, and the medical examiner’s office has never stopped testing the remains recovered from the wreckage. In August 2025 the office returned Barbara Keating’s name to her family, using DNA from a hairbrush from her Palm Springs home, left behind before a summer on Cape Cod with her grandchildren. A faker would have had to plant that hairbrush, seed it with her DNA, coach her son on the scrap of ATM card, and hold the construction together for 24 years. Nobody did. The hairbrush sat in a family’s house, and then it did the one thing the theories never could. It gave a passenger back.

Twenty years ago, give or take, a friend told me a story he expected me to admire. He was a Latter-day Saint who worked in technology, and he was, as I understood it then, the bishop of his ward, an unpaid office the church gives to laymen who keep their day jobs, so he kept a company’s hours all week and presided over a congregation on Sundays. There was a Mormon bookstore he went into often, and one day he walked in and found a new display for Goosebumps, the paperbacks with the dripping green logo about haunted masks, a ventriloquist’s dummy with a mind of its own, and a werewolf in a Florida swamp. He spoke to the owner. The owner [told him the books were selling well](https://prairievoice.com/p/the-bare-shelf ) and that those sales were keeping the store alive. My friend pressed him on content, judged the whole series blasphemous, an invitation to the occult at a child’s price, and let it be understood that if the titles stayed on the shelf a report would go to the stake president. A week later he came back. The books were gone, the owner was distant and cold, and my friend bought a couple of books, in his own phrase, to make up the difference. He told me this the way another man might tell you he had coached his kid’s team to a championship. He was proud. The word I have settled on, twenty years later, is forensic: he had investigated, prosecuted, and won, and he walked out of that store on the high of it.
I was an author and a publisher then, as I am now, and I was sad, and I was offended, and I remember being surprised by the size of both feelings. He had done nothing to the books. R.L. Stine had sold well past a hundred million copies by then and would keep selling them without any help from that store. What my friend had done was reach into the lives of every family who shopped there and remove an option they had never asked him to weigh for them. He had also reached into a merchant’s ledger, on the merchant’s own testimony, and cut the line that was paying the rent. The children of that congregation came out of it with a new errand: find the haunted mask somewhere else, which they would, and learn in the finding that the forbidden thing is the interesting thing. [Our friendship ended over it, slowly and then completely,](https://bolesblogs.com/2026/07/20/havent-we-always-been-friends/ ) and I have turned the story over for two decades because I have come to believe he was describing a pleasure. That pleasure is the subject of this article.
The feeling has a pedigree older than any church. Plato had it. In the Republic, Socrates proposes that the guardians of the ideal city be raised on stories purged of quarreling gods, of a frightening underworld, of heroes weeping over their dead. Homer would be edited. Hesiod would be edited. A poet who declined the edit would be crowned with wool, anointed with myrrh, praised as a holy and wonderful creature, and walked to the border. What makes the passage worth rereading twenty-four centuries later is the cheerfulness. Socrates lays out the whole scheme like a man planning a garden. He is designing a nursery in which no child will ever meet a ghost, and he is certain the nursery is a gift.
Florence learned what the nursery costs. On the seventh of February, 1497, the friar Girolamo Savonarola sent bands of boys through the streets to collect the vanities of the city, and the city handed them over: mirrors, cosmetics, playing cards, dice, wigs, secular songbooks, manuscripts of Ovid and Boccaccio, paintings of women who were not the Madonna. The pile in the Piazza della Signoria rose higher than a house and burned all afternoon while the boys sang. The boys are the point. Savonarola put children in charge of taking things from their own parents, taught them the taking was holy, and the children discovered what every censor’s foot soldier discovers, that there is a thrill in being the one who is allowed to seize. Fifteen months later the city hanged and burned Savonarola in the same square. The mirrors came back. The thrill had already been taught.
Rome made the pleasure permanent. The Index Librorum Prohibitorum, the Catholic list of forbidden books, began in 1559 under Paul IV and ran until 1966, four centuries of a committee in an office deciding what the faithful of the whole world would be denied. Copernicus went on it, and Galileo, Kepler, Descartes, Pascal, Locke, Hume, Kant, Voltaire, Rousseau, Hugo, Flaubert, and Zola. The list reads like the syllabus for a good education, which is the joke history plays on every index. Any list of what the pious may not read becomes, inside a generation, the list of what the curious will read first. By 1966 the Index had become an advertisement for its own contents, and the church quietly retired it.
England tried the bonfire without the fire. In September 1642 the Puritan Parliament ordered the playhouses shut, and they stayed shut for eighteen years. Five years after that the same Parliament abolished Christmas, the feast and the games and the twelve days a poor household could count on someone else’s table, and in 1659 the Massachusetts Bay colony fined anyone caught keeping the day five shillings. The takers describe what they take as nothing, so let me itemize it: the whole of Shakespeare gone from the stage for a generation, so that a man who had grown up on Lear now had no Lear, and a servant’s one holiday, and the maypole. Thomas Morton raised one at Merry Mount in 1627 and danced around it with his settlers and their Native neighbors, and William Bradford recorded the scene with disgust, as a revival of the beastly practices of the mad Bacchanalians. Myles Standish arrested Morton and shipped him to England, and John Endecott had the pole cut down. The offense was company: people of two nations drinking together in the woods with a fiddle. The ban was written in the language of God’s honor, and the pleasure was in the cutting.
H.L. Mencken watched the descendants of those Puritans at work in Boston and defined their creed in a line that has outlived everything they banned: the haunting fear that someone, somewhere, may be happy. He was mocking them and he was also diagnosing them. The definition skips sin entirely and lands on the other person’s happiness, which is where the pleasure of the censor has always lived. Anthony Comstock proved it with numbers. For more than forty years he served as a special agent of the Post Office with power over the mail of the United States, and in 1913, two years before he died, he summed up the career for an interviewer. He had convicted enough people to fill a passenger train of sixty-one coaches, sixty of them carrying sixty passengers each and the sixty-first nearly full. A hundred and sixty tons of literature had gone to the pulp mill on his word. He counted suicides too. When the abortionist Madame Restell cut her throat in 1878 after he arrested her in her own home, he called her death the fifteenth suicide he had caused, and the count was a boast. In 1902 he pursued Ida Craddock, who wrote pamphlets of advice for the newly married, through a workhouse sentence and into a federal conviction, and on the day she was due to report to prison she killed herself and left a public letter naming him. Comstock kept a collection of everything he seized, called it his Chamber of Horrors, and carried it to Washington to show congressmen. The man who had read more obscenity than anyone in America was the man who had decided no one else could.
Heinrich Heine wrote, more than a century before it happened, that where they burn books they will in the end burn people, and Germany tested the line on the tenth of May, 1933, when students in Berlin and more than thirty other university towns hauled Heine’s own work, along with Freud, Heinrich Mann, Remarque, Kästner, and Helen Keller, onto bonfires while Goebbels made a speech. I bring the Nazis in for one reason, which is that their fire is the one everyone agrees to condemn, and it ran on the fuel of the church bookstore: the conviction that the reader is weaker than the page, that a nation or a congregation or a child must be kept from an idea because the idea will win. Only the scale differs.
America answered the German fires fifteen years later with fires of its own, and children lit them. In October 1948 in Spencer, West Virginia, a thirteen-year-old named [David Mace stood before six hundred schoolmates and a pyre of two thousand comic books they had spent a month collecting door to door](https://bolesblogs.com/2026/08/09/no-one-dies-lying/ ), recited a pledge that comics were mentally, physically, and morally injurious, and added a line no adult could have improved: we also pledge ourselves to try not to read any more. His reading teacher had recruited him. Weeks later the students of St. Patrick’s parochial school in Binghamton, New York, went house to house asking whether there were any comic books in the home, gathered two thousand, and burned them in the schoolyard, and Time magazine ran the pictures. David Hajdu counted fifteen such burnings in his history of the comic-book scare. The Charleston Daily Gazette, in the same state as the Spencer fire, printed an editorial saying the obvious, that the burning of books was too recent in the country’s memory, that the Nazis had done it and had gone on to burn the authors. Spencer was not listening. By 1954 the psychiatrist Fredric Wertham had published Seduction of the Innocent, the Senate had held its hearings, and the publishers had saved themselves with the Comics Code, which forbade the words horror and terror in any title and banished vampires, werewolves, ghouls, and the walking dead from the American newsstand. The horror comic died. Its readers grew up, and one of them, a boy from Columbus, Ohio, whose own mother had banned the comics from the house so that he read them at the barbershop, wrote Goosebumps.
The pattern repeats so faithfully you can set a watch by it. In 1985 the Parents Music Resource Center, founded by Tipper Gore and Susan Baker, asked the record industry to rate albums with letters, and one of the proposed letters was O, for occult. Frank Zappa went before the Senate Commerce Committee that September and told the senators that in law First Amendment questions are decided in favor of the least restrictive alternative, and that measured by that standard the PMRC’s demands amounted to treating dandruff by decapitation. Then he said the thing my friend never heard anyone say to him. Nobody had forced Mrs. Gore or Mrs. Baker to bring Prince into their homes. They were free to buy other records for their own children. What they wanted was a label on everyone else’s.
Then came the boy wizard. Harry Potter was the most challenged book series in America for the whole of the 2000s by the American Library Association’s count, and the objections were the Goosebumps objections with the serial numbers filed off: witchcraft, the occult, sorcery presented as fun. A church in Alamogordo, New Mexico, burned the books at the end of 2001, and a church in Pennsylvania had burned them that spring, on the theory that a British boarding school with a flying-broom sport was a recruiting office for Satan. In 2019 a Catholic school in Nashville pulled the series from its library on the pastor’s written finding that the spells in it were real spells. Goosebumps itself sat at number fifteen on the ALA’s list of the hundred most challenged books of the 1990s, for being too frightening for young readers and for its occult and demonic themes, and the most challenged book of that decade was Alvin Schwartz’s Scary Stories to Tell in the Dark, a folklore collection. The line runs straight from the Republic to the strip mall. Somebody, in every century, decides that children must be kept from the dark, and the children, in every century, find the dark anyway, usually under the covers with a flashlight, and grow up fine.
The pleasure has an anatomy, and the first part of it is cheapness. A ban costs the banner almost nothing, and in my friend’s case the price is on the record: a couple of paperbacks, bought to make up the difference against a line of sales the owner had just said was keeping his store alive. There is an old name for that purchase. Conscience money is what the English called the anonymous sums that tax cheats mailed to the Exchequer to feel square, and two books against a store’s survival is conscience money at the exchange rate censors have always preferred. He wrote no book, raised no child besides his own, built no better bookstore; he had one conversation and walked out with a scalp. Every other form of moral labor asks for years. This one asks for an afternoon and rewards it with the feeling of having done something, and no feeling is more addictive.
Enlargement is the second part. A man who empties a shelf has made his private taste into public law for everyone who shops there, and a private taste that becomes law feels, from the inside, like authority. My friend brought the stake’s taste to the counter, on loan, and left his own at home. In that church a stake president sits above the bishops of several congregations and is one of the two officers who sign a member’s temple recommend, and a Mormon bookstore lives or dies on the goodwill of the stake it serves, so a hint that a report might travel upward was all the order the afternoon required. A bishop hinted, an owner who could not afford to test the hint did the arithmetic, and the shelf was cleared without a word from the church itself, and that is how most shelves get emptied: by a committee of one who borrows a larger committee’s name for an afternoon, and a merchant or a clerk who cannot afford to find out whether the borrowing is real. The third part is exemption, and the censors never mention it. To judge the book you have to read the book. Comstock inspected a hundred and sixty tons. Wertham read the comics. My friend, to know that Goosebumps was blasphemous, had to know what was in Goosebumps, which means he had read the haunted mask and the living dummy and the werewolf of Fever Swamp and had survived, and had then decided that other people’s children could not be trusted with what he had handled unharmed. Every ban is also a license, issued to one person, and the person is the banner.
Taken to its limit, the pleasure takes away people. When Jakob Ammann split the Swiss Brethren in 1693, the quarrel was over how hard to shun, and the sects that keep a shunning rule to this day order the faithful to stop speaking to a brother or a daughter who has left. That is the emptied shelf applied to the dinner table. My friend’s church asked nothing of the kind from him and I will not pretend it did. I raise it because the logic is continuous. A movement that believes it may decide what you read will, given time and a committee, believe it may decide whom you love, and the second belief feels, to the people holding it, like the first one grown up.
The genius of the argument against all of this belongs to John Milton. In 1643 Parliament had ordered that no book be printed without a license, and Milton, who had himself been reported to it for printing without one, wrote Areopagitica the next year to shame the members out of the order. His case runs deeper than the free-speech slogans it later fed. He says a man who kills a good book kills reason itself, since a book is the living extract of a mind. He says he cannot praise a fugitive and cloistered virtue, one that has never sallied out to see its adversary, because a virtue that has never met vice has never been tested and cannot be called a virtue at all. And he says the licensers will be either the ignorant, who cannot judge, or the learned, who will find the work beneath them and pass it to clerks. Every part of that has come true in every century since. The licenser of Goosebumps was one man in a bookstore. His protected virtue was a virtue that had never met a ghost. And the reason he killed was the reason of every child who might have learned, from a cheap paperback, that fear can be faced on a page and put down when the chapter ends.
Science, for whatever a censor cares about it, sides with Milton. Mathias Clasen runs the Recreational Fear Lab at Aarhus University and wrote Why Horror Seduces, and his work on people who seek fright on purpose supports what any Goosebumps reader could have told him: the fear is a rehearsal. Children in particular use frightening stories to practice the emotion at a dose they control, with the closed book as the exit, and the practice is a kind of mastery. The Harvard folklorist Maria Tatar has made the case for the Grimms, whose tales are bloodier than anything Stine ever wrote and were told to children for centuries by people who understood, without a laboratory, that a child who has met the wolf in a story is better armed for the wolf in the woods. Take the wolf out of the story and you have taken nothing out of the woods.
Now a fair hearing for the other side, because an argument that never meets its adversary is Milton’s cloistered virtue in a different coat. The bookstore was private property. Its owner could have said no, no constitution was violated when he said yes, and none was violated by the hint that made him say it. I grant it in full; my quarrel was never with the law. A private censorship is still a censorship in its effects, and the question I put to my friend was whether it was a virtue, a question on which the law is silent. The second objection is stronger. Parents have the right to guard their own children. They do, and the right is exhausted at their own front door. Declining to buy Goosebumps for his own kids would have had my blessing. He went further and decided for every parent in that store, including the ones who had already decided the other way, and he counted their loss as his win.
A third objection says the books were junk, and asks why anyone should care about junk. Comstock started with dirty pictures and moved on to anatomy textbooks and adventure novels; every taste does that once it is armed, and in any case junk is where readers begin: Scholastic and a great many librarians credit Goosebumps with turning reluctant readers into readers, and the boys who read it are the men now buying hardcovers. The fourth objection is the one he would have made himself: the church teaches that some things must not be trifled with, and ghosts are among them. I will answer it from inside his tradition. The Bible he read has a ghost in it. In the twenty-eighth chapter of the first book of Samuel, King Saul goes by night to a woman at Endor who raises the dead prophet from the ground, and the prophet speaks, and Saul falls to the earth in terror. Latter-day Saint folklore has its own uncanny visitors, the Three Nephites, deathless men out of the Book of Mormon who turn up on lonely roads to help stranded travelers and then vanish, and the folklorist Hector Lee collected their legends into a book in 1949. The tradition that found a green paperback blasphemous has been telling its own children ghost stories since the tradition began.
This method has children of its own now, and most of them have learned to avoid the word ban. The publisher who quietly rewrites a dead author is one. In 2023 Roald Dahl’s estate and his publisher issued editions of his children’s books with hundreds of small deletions and substitutions, Augustus Gloop no longer fat, the Oompa-Loompas no longer small men, on the advice of sensitivity readers, and the outcry was loud enough that the publisher agreed to keep the originals in print beside the revisions. Thomas Bowdler did the same to Shakespeare in 1807 and got a verb named after him for his trouble. Ballantine Books did it to Ray Bradbury, of all people, issuing a high school edition of Fahrenheit 451 in 1967 with the damns and hells removed and a drunk man turned into a sick man, and from 1973 printing only the cleaned version, so that for six years the novel about burning books existed in America only in a form its author had never approved. Bradbury found out in 1979 when a friend handed him a copy. He got the original restored and wrote a coda about it that now travels with every edition. It went unremarked for so long because there was no note on the copyright page, which is the modern censor’s chief improvement on Savonarola. The friar burned in public. The publisher deletes in private and calls it an update.
Other children of the method wear badges and letterheads. The school board that removes a novel because one parent filled out a form, the library weeding that happens to weed in one direction, the payment processor that informs a storefront which titles it will no longer process, the rating that slides a book from the shelf a child can reach to the shelf a child cannot: each of these is the emptied shelf with better paperwork. PEN America has been counting removals from American school libraries by the thousand every year of this decade, and the objections on the forms are Wertham’s and Comstock’s and my friend’s, reworded for the era. The motive is Plato’s, and only the vocabulary is new: it speaks of safety and appropriateness and community standards, and I distrust every one of those words in the mouth of a person who is describing what other people may not have.
Here is the genius of the argument, and it is the part my friend could never have answered. The censor fails at his own task every time, and he fails by the mechanics of the thing he does. Boston’s Watch and Ward Society spent decades getting novels banned in Boston, and publishers learned to print the phrase on the jacket, because a ban in Boston sold books everywhere else. The Index ran for four centuries and the books on it became the canon. The Comics Code killed the horror comic and produced, a generation later, the most successful children’s horror series in the history of the trade, written by a boy who had read the comics before the Code took them away. Harry Potter survived every bonfire and sold more than half a billion copies. Goosebumps, with my friend’s help, passed four hundred million. Every emptied shelf is a signpost that says the good stuff is over there. The censor has reduced the supply of a thing in one place while raising the demand for it in every other, and the children of his own congregation learn from him which books are the ones worth finding.
And then the friendship. I have to answer for that, because a hostile reader will point out that I ended a friendship over books and will ask whether I ran a morality committee of my own. The difference is the whole argument. When my friend cleared the shelf, he took something from people who had not consented and who never knew his name. When I stopped calling him, I took something that was mine to give, my company, and I took it from two people only, myself and him, and he knew why. Mine was the second friendship the ban cost him; the first belonged to the owner, who had sold him books for years and who, on the day of the triumph, had gone distant and cold. That is the line between exit and censorship, and it is the only line that matters. You may refuse to read a book, refuse to buy one, refuse to stock one in your own store, refuse to let it into your own house, and refuse to keep company with the man who bans it; all of that is choosing for yourself. The moment you reach across the counter and choose for a stranger, you have joined Savonarola’s boys, and you are carrying a stranger’s mirror to the fire and calling the weight in your arms a virtue.

He was proud when he told me, and he would be proud now, since he believed then, and believes today, that he was serving God’s discipline; I expect he would read this article with delight and count it as one more witness to the win. I think of him when I pass a shelf with a gap in it, the kind a hand leaves when it takes a book that was not its own, and what I see in the gap is a child, eleven or twelve, standing in that store, reaching for the green spine that was there last week and finding bare board, and being told, if the child asks, that it was for his own good. [The child will find the book](https://bolesbooks.com/technology/censor-copy/ ). The child will also remember the shelf. And the man who emptied it went home pleased, which is the only part of the whole transaction that was ever about him.

*From Nebraska to New York, the silos are hollow until hallowed. *The elevator starts before the sun does. On a November morning in 2019, I stood by a rail siding in a county-seat town in Nebraska and watched a truck empty itself into the pit while the leg lifted the corn a hundred feet into the headhouse, kernel by kernel, out of sight. What stays with you is the sound. A grain elevator at work has a voice like weather, a steady granular rain inside a concrete throat, and the dust it exhales catches the first light and holds it for a moment above the tracks. The building does one thing a child could explain: [it keeps the harvest, standing at the edge of town](https://bolesblogs.com/1998/07/01/a-1984-north-loup-photo-memory/ ), taller than the church, the courthouse, and the water tower, doing that one thing for a hundred years. Yet the same word that names this building now names the most despised structure in American institutional life. Say “silo” in a boardroom or a hearing room and the response arrives on reflex: break them down. Somewhere between the rail siding and the hearing room, the container became the crime.
The aphorism over this page makes a quieter claim. Hollow until hallowed. A silo, concrete or corporate, begins as pure capacity, an absence arranged for storage. Nothing in the cylinder itself is virtuous or corrupt. It keeps whatever it is given: grain or rot, a town’s livelihood or a file that could have saved thousands of lives. What the container becomes depends on two acts that always arrive later, the filling and the blessing. Those two acts mark the map the epigraph draws, from the elevators of the Plains to the silos of New York, literal and institutional, and the questions worth asking of any container come down to three: what it holds, who blessed it, and when it opens.
The machine comes first, because the epigraph’s geography is accurate before it is poetic. The grain elevator was born in New York State. In 1842 a Buffalo merchant named Joseph Dart rigged a steam engine to an endless belt of buckets and called it a marine leg, and his contraption lifted grain out of a lake boat at two thousand bushels an hour, work that had taken a full gang of men a full day in good weather. Buffalo’s wooden elevators became tourist attractions; the world, as the city’s architectural historians put it, had never seen anything like it. Fire and insurance premiums eventually forced the wood out, and after 1900 the elevators rose again in steel, tile, and reinforced concrete, at a scale the historians call monstrous. Meanwhile, in 1873, a McHenry County, Illinois, farmer named Fred Hatch built what agricultural histories generally credit as the first modern American farm silo, a walled pit of brick, wood, and cement meant to keep feed from spoiling through the winter. From those two beginnings, the lake port and the farmyard, the cylinder spread across the Plains until every siding town had its tower and every tower wore its town’s name down the side.12
The physics arrived next, and it is load-bearing for everything that follows. In 1895 a German engineer named Janssen set square wooden bins on scales and measured what grain does. Water in a tank presses on the bottom in proportion to its depth, without limit. Grain refuses. As the fill rises, the pressure at the floor climbs, then slows, then levels off, because the kernels lean against the wall and the wall carries the difference. Janssen’s equation still anchors the silo design codes of most nations, and the finding is plain. The wall participates. The boundary shares the weight of what it holds. A structure built on the assumption of mere containment would burst; the working silo stands because its sides consent to be leaned on.3
The first hallowing came from Europe, and it was aesthetic. In 1913 Walter Gropius published photographs of Buffalo’s Washburn-Crosby and Dakota elevators in the yearbook of the Deutsche Werkbund, and the pictures moved through the avant-garde like fire through a field. Erich Mendelsohn sketched elevator forms from 1914 onward and made a pilgrimage to Buffalo in 1924 to stand at the feet of the monoliths. Le Corbusier printed the photographs in Vers une architecture in 1923 beside sentences that read like consecration: the American grain elevators and factories are “the magnificent first fruits of a new age,” he wrote, and “the American engineers overwhelm with their calculations our expiring architecture.” Sixty years later the historian Reyner Banham gave the transfer its name in A Concrete Atlantis. The industrial buildings of the United States taught Europe how to imagine the modern. Note the order of events. Americans built a machine for moving grain. Europeans pronounced it holy. Americans went on using it as plumbing. That blessing cost the Europeans nothing and fed the silo nothing, and an act of hallowing can be exactly that cheap.4
The word’s second career began in 1988, when a Goodyear executive named Phil Ensor coined “functional silo syndrome” in Target, the magazine of the Association for Manufacturing Excellence. An organization with the syndrome, Ensor wrote, behaves “out of a foundation of mistrust and a lack of mutual concern”; it suffers “a very damaging learning disability,” having never learned how to learn. Peter Senge’s stovepipes followed in 1990, and the consulting age had its diagnosis. That diagnosis earned its authority the hard way. In January 2000 the Central Intelligence Agency learned that Khalid al-Mihdhar held a valid United States visa and that Nawaf al-Hazmi had flown to Los Angeles after a meeting of al-Qaeda figures in Malaysia. Fifty to sixty CIA personnel read the cables. An FBI agent assigned to the CIA drafted the notice that would have told his own Bureau, and the notice was held, and no one ever explained why, while the two men settled openly in San Diego, rented an apartment, opened bank accounts, took flight lessons, and listed a name in the telephone directory. They were added to the watchlist on August 24, 2001. Less than three weeks later they were aboard the flight that hit the Pentagon. The Justice Department’s inspector general, reconstructing the failure, quoted a senior counterterrorism official’s verdict: “Information that should have been shared was not, repeatedly.” The 9/11 Commission stated the cultural fact beneath the case: there are no punishments for not sharing, and the agencies kept a “need-to-know” culture where the record demanded “need-to-share.” Gillian Tett, a Financial Times journalist trained as an anthropologist, gave the condition its modern name in 2015 with The Silo Effect, and her exhibits include Sony guarding its PlayStation division while the digital music market walked out the door. Her counterexample matters as much: the New York City fire department learned to predict fires by gathering data across departmental lines, proof that the cure for a silo is a discipline of exchange rather than a demolition of structure. Grant the charge in full, because it is true and because it has a body count. A silo that hoards can kill at scale.567
What the record cannot carry is the catechism built on top of it, the consulting creed that every wall is a defect and every container an occasion for demolition. Grain disagrees. A harvest is stored by crop, by grade, and by moisture, because mixing spreads spoilage and spoilage spreads loss; the partition is the preservation. Fire disagrees more violently. On December 22, 1977, at Westwego, Louisiana, dust hanging in the connected air of the Continental Grain elevator met an ignition source, and the blast ran bin to bin through a battery of seventy-three silos, blew the tops off more than forty of them, and dropped the 250-foot headhouse onto the office where men had come in on their day off to collect the company’s Christmas turkeys. Thirty-six people died, the worst toll of four American elevator explosions that week and the deadliest in the industry’s modern record. Rules written in that ash did something the keynote speakers never propose. They mandated compartments: isolate the headhouse from the places where people work, separate the dust, vent it, clean it. Safety engineers understood what the anti-silo sermon keeps missing. Containment is how one failure is kept from becoming everyone’s failure.8
Organization theory said all of this earlier and more calmly. In 1976 Karl Weick described the loosely coupled system in Administrative Science Quarterly. Units buffered from one another gain a kind of insurance, since local failure stays local and local knowledge stays alive, while a system tightened end to end synchronizes its catastrophes. The first question to ask of any wall slated for demolition is what it has been carrying. Turn, then, to the federal response. After 2001 the United States did not abolish its silos. On December 17, 2004, the President signed the Intelligence Reform and Terrorism Prevention Act, the largest reorganization of American intelligence since 1947, and the country built new containers with consecrated names: a Director of National Intelligence, a National Counterterrorism Center, an Information Sharing Environment. Those reformers understood what the conference circuit does not. Human beings cannot be organized without containers. The work is deciding what each one holds, who holds the keys, and what becomes of the keeper who refuses to open it. What failed before 2001 lived in the filling and the blessing; the concrete stood blameless.910
Now the stakes, in flesh. Purdue University’s annual summary of agricultural confined-space incidents counted fifty-one cases in 2024, twenty-two of them fatal, and grain entrapment leads the ledger year after year. The mechanism is Janssen’s physics running the other way. Spoiled grain crusts over a void, and a worker walks onto a bridge that is secretly air; or the auger starts beneath the worker and the surface becomes a funnel. A person sinks past the point of self-rescue in seconds, and the same friction that lets the wall carry the load locks the body where it sinks, so that rescue crews must drain or cut the bin to reach the person inside. The silo kills the people it feeds. Every autumn the extension services publish the same liturgy, never enter alone, lock out the auger, wear the harness, and every autumn the count returns. The institutional mirror is exact. The clearest victims of an information silo are the people who climb inside it to fix it: the agent whose warning cable was never sent, the analyst who flagged the risk and was answered with procedure. Any hallowing worth the word begins by honoring what the container consumes.11
On the Plains the sequence runs emptying first and consecration second, when there is a second at all. Drive the old rail corridors and read the gaps. The wooden country elevators that anchored every siding town are going down to fire, to the wrecking crew, to the arithmetic of unit trains and on-farm bins, and a town can lose its elevator the way a mouth loses a tooth; the gap whistles. What remains gets hallowed by the people who stay. They paint the town’s name down the headhouse. They put the elevator on the city seal and the festival banner. The preservationists’ name for the survivors is prairie sentinels, and the name is itself a small consecration, a way of saying that the building held a community’s livelihood for a hundred years and the holding mattered. From Nebraska, the epigraph reads as elegy: hollow until hallowed, and hollow again if the blessing lapses.
New York answers in two registers, and neither rhymes with Nebraska’s. The literal register stands in Red Hook, Brooklyn, where the state opened a grain terminal on September 1, 1922, to feed a barge canal that was obsolete on arrival; Governor Nathan Miller conceded at the opening ceremony that the terminal and its canal were already obsolete, worth keeping in case of emergency. It cost two and a half million dollars it never earned back, passed to the Port Authority in 1944, watched the St. Lawrence Seaway finish off its purpose in 1959, and was deactivated in 1965. They call it the Magnificent Mistake, a silo hollow from birth, and its consecrators arrived late and carry cameras: urban explorers, film crews, a thin congregation of ruin-lovers in the mold and the pigeon light. The metaphorical register is the one the epigraph indicts, and it is worse. Manhattan’s institutional silos, the banks before 2008 whose risk desks could not see over their own walls, the agencies before 2001, the bureaus and funds and newsrooms since, run the sequence in reverse. Hallowed first, by marble and prestige and clearance and brand, and only later discovered hollow: of risk sightlines, of shared memory, of anything kept for the common table. On the Plains a silo earns its blessing by keeping something alive through winter. In the towers the blessing arrives prepaid on the first day, and the contents are audited after the fire.12
The oldest text here already had the order right. In Genesis 41, Joseph stores the grain of seven fat years “like the sand of the sea,” past counting, and the storehouses of Egypt are holy for one reason: they open in the lean year. Storage consecrated by distribution. A granary that never opens is a tomb with a payroll. Measure every silo by its outflow, then, because that is the one audit that cannot be gamed: what came back, when, and to whom. The department that hoards its data until the subpoena, the agency that guards its cables until the commission convenes, the town that discovers its love for the elevator on the morning the demolition permit posts: each kept a container and skipped the consecration, which lives in the discipline of opening at the right time to the right people rather than in the architecture or the sentiment.
One working answer to the epigraph stands where the building and the word both began. On May 4, 2013, the Just Buffalo Literary Center booked the Marine A silo, a hundred and twenty feet of emptied concrete on the Buffalo River, for what was meant to be a one-time book release party, and the Silo City Reading Series has filled the cylinder with voices every summer since. Poets read from a wooden pallet stage; their eyes climb the walls first, as founder Noah Falck describes it, before settling at the level of the audience; the curved concrete returns each line altered, as though the building were reading back. Thirteen years on, the roster runs from Ocean Vuong to Jericho Brown to Maggie Smith, and there is an anthology pressed from the echoes. That silo holds nothing but evenings, and its emptiness now does work that no purpose-built hall can do, because the hallowing there is performed, renewed, and shared, season after season.13
Back to the November siding. The truck pulls away empty. The leg winds down, the rain inside the throat stops, and the dust settles out of the light a particle at a time. Inside the headhouse the corn lies quiet, the year’s work stacked by grade and moisture behind walls that carry their share of the weight, waiting for the lean season to call it by name. A container that remembers the harvest holds more than grain. It keeps faith with the summer until the spring asks for it back.##

“Because you’re worth it.” Four words, running in L’Oréal advertising since 1971, and by the time you reached the period you had already done the heavy lifting. No one told you that personal worth justifies the purchase, that expensive cosmetics are how worth gets expressed, that you in particular qualify for the category. You supplied every one of those claims yourself, silently, in the half second the slogan allowed. The advertiser handed over a conclusion and trusted you to build the staircase leading up to it.
That trust carries an old name. Aristotle called the move an enthymeme, and he treated it as the engine room of persuasion. In the first book of the Rhetoric he scolds the handbook writers of his day for fussing over how to make a jury angry or sympathetic while ignoring the one thing that does the real work. Those writers, he complains, say nothing about the enthymeme, which he calls the body of proof, and busy themselves instead with matters outside the question at hand. The phrase repays attention. Body of proof. [In the Poetics](https://bolesblogs.com/2009/12/20/poetics-primer/ ) he names plot the soul of tragedy; here the enthymeme becomes the body of argument, the part with weight and motion. Strip it out and the speech has no skeleton left to stand on.
So what is the thing itself? Start with the textbook version, because the textbook version is what made the enthymeme famous and useful. A full syllogism marches in three steps. All men are mortal. Socrates is a man. Therefore Socrates is mortal. An enthymeme cuts a step and lets the audience put it back: “Socrates is mortal, because he is a man.” The major premise, all men are mortal, never gets spoken aloud. It does not need to be. You already hold it, so making you sit through it would insult you and waste the speaker’s breath. The same machine runs the old proverb “where there’s smoke, there’s fire.” Nobody states the premise that smoke comes from fire. Whoever hears it supplies the link and feels a little clever for the contribution.
The word itself tells the story. Enthymeme comes from the Greek for keeping something in the mind, en (in) joined to thymos (mind, spirit). The suppressed premise goes somewhere specific when it leaves the sentence. It moves into the listener’s head, which is exactly where the speaker wants it, because persuasion that happens inside your own skull, in your own voice, carries an authority no outside voice can match.
A word of caution before we go further, because the textbook account hides a quarrel that working writers should know about. The neat picture of the enthymeme as a syllogism with one leg sawn off is the popular reading, and scholars have spent a century arguing that it oversimplifies Aristotle. When he says the device often runs on fewer premises, several interpreters point out, he may be describing which premises a speaker should select rather than any logical amputation. His own examples frequently refuse to match the tidy three-line form from his logical works. The reduction to “incomplete syllogism” hardened into orthodoxy largely through later teachers who wanted a rule they could hand to students. The popular definition remains the most useful handle anyone has on the device, and it deserves to keep its place. It also deserves an asterisk. The gap-filling model is a strong approximation, and the source material underneath runs richer and stranger than the handbook lets on.
Set the scholarship aside and ask the practical question. Why does the half-said argument beat the fully said one so reliably? The answer lives in a single fact about human attention: we defend what we build. A conclusion delivered whole arrives as someone else’s property, and a listener inspects it the way you inspect a used car, hunting for the dent. A conclusion you assemble yourself arrives as your own idea, and people rarely audit their own ideas with that same suspicion. The enthymeme converts the audience from jury into accomplice. Psychologists describe a related finding under the name of the generation effect: material you produce yourself lodges in memory better than material you only read. The enthymeme turns that tendency into a tool of persuasion. By demanding a small act of mental production, the speaker makes the conclusion feel home-grown, and home-grown beliefs are the ones we will fight to keep.
Notice what this does to resistance. When a debater states every premise, each one becomes a target you can shoot down. The suppressed premise offers no surface to shoot at, because it was never placed in the open. It slipped in through the back, wearing your own handwriting. That is the device at full strength, and it explains why the most effective persuasion often feels less like being argued at and more like agreeing with yourself.
Aristotle had a further reason for placing the enthymeme at the heart of rhetoric, and it matters for understanding why the device turns up everywhere. He built rhetoric to operate in the realm of the probable, the world of human affairs where certainty is not on offer. Mathematics can prove. A courtroom, an assembly, a marketplace can only persuade, because the questions they face (did he do it, should we go to war, is this worth buying) admit no proof of the geometric kind. The enthymeme runs on what Aristotle called probabilities and signs, the things that hold for the most part rather than always. That snug fit with the human world is the point. We spend our lives reasoning from the likely, the typical, the usually true, and the enthymeme is the natural grammar of that kind of thinking.
Step back from slogans and trials and listen to ordinary talk for a minute, because the enthymeme governs that too, far below the level of oratory. The device is the default setting of human speech. “Take an umbrella, it’s going to rain.” “He’ll be late, he always is.” “Don’t eat that, it’s been in the sun all afternoon.” Every one of those sentences buries a premise so obvious that stating it would make you sound deranged. Rain makes you wet, lateness is a habit, heat spoils food. We never say the middle term, because conversation would seize up if we did, and because treating an adult as though they needed the spoiling-food rule explained would be its own small insult. The enthymeme is popular for the plainest reason available: speaking any other way would be unbearable. We are all fluent in it before we can read.
Here the craft turns sharp, and here the honest practitioner separates from the manipulator. The premise a speaker chooses to suppress is often the weakest one, the claim that would wither in daylight. Take the political line “we can’t trust him, he’s a politician.” The stated premise is harmless. The buried premise is the whole argument: politicians cannot be trusted, all of them, as a class. Say that out loud and a thinking listener objects at once, because the generalization is plainly false. Leave it unspoken and it does its work unchallenged, because the audience that already half-believes it will rush to complete the thought. The enthymeme, then, is the natural hiding place for the premise that cannot defend itself. Aristotle saw this coming. He gave a whole chapter of the Rhetoric to what he called apparent enthymemes, the counterfeits that wear the costume of proof and deliver only the feeling of it. The man who catalogued the device also catalogued its forgeries.
This is the part working writers most need to hold onto. The same structure that makes an argument elegant makes a lie efficient. An enthymeme resting on a true and shared premise honors the reader. An enthymeme resting on a false or ugly premise that the audience happens to hold lets the speaker keep his hands clean while the audience does the dirty work. The device itself carries no morality; the morality lives entirely in the premise you choose to bury.
Advertising grasps this better than any philosophy department. “Just do it” suppresses an entire worldview: hesitation is failure, action is virtue, and the shoe is the uniform of people who act. Nike never argues the case, because arguing it would expose it to doubt. The brand assumes the premise and invites you to live inside it. “Got milk?” assumes that milk belongs at the center of a meal and that running out counts as a small domestic crisis. Each slogan is effective because it hands you a conclusion whose foundation you feel flattered to lay yourself, and the laying registers as recognition rather than persuasion.
Political slogans burn the same fuel, and the most successful ones bury their biggest claim, whatever the party flying them. “Make America great again” carries a hidden premise doing all the labor: that the country has fallen from a former greatness. The slogan never argues the decline, never dates it, never defines the greatness it promises to restore, because argument would invite scrutiny and scrutiny is the enemy. It assumes the loss as settled fact and lets every listener fill the void with a private picture of the better past they remember or imagine. There sits the genius and the menace in one package. The slogan is effective because it recruits a hundred different grievances into a single line without committing to any of them. It is not effective as honest argument, because the load-bearing claim is the one it refuses to state or test.
Courtrooms run on enthymemes from opening statement to verdict. A prosecutor who says the defendant had motive, means, and opportunity has left the governing premise unspoken: that a person holding all three is probably guilty. The jury supplies it. A defense attorney who reminds the room that the state’s only witness cut a deal hangs the premise “witnesses who bargain for leniency lie” in the air for twelve people to seize. Aristotle classed forensic speech, the rhetoric of accusation and defense, among the three great genres of oratory, and the modern trial shows how little the underlying machinery has shifted in twenty-four centuries.
For the device at its highest pitch, go to the theater. Shakespeare’s Mark Antony, standing over Caesar’s corpse in a hostile forum, faces a crowd primed to cheer the assassins. He cannot call Brutus a murderer; the mob would tear him to pieces. So he builds the most lethal enthymeme in English drama out of a single repeated phrase. “Brutus is an honourable man.” He says it, then lays a fact beside it that contradicts it. Caesar refused the crown three times; Brutus is an honourable man. Caesar wept for the poor; Brutus is an honourable man. Antony never states the conclusion that Brutus is a liar and a butcher, because he cannot afford to. He widens the gap between the praise and the evidence until the crowd leaps across it on its own and lands, breathless, on the verdict he wanted all along. The speech is effective because Antony makes the mob believe it discovered the truth without his help, which is the only route by which a hostile audience ever changes its mind. Had he simply called Brutus a traitor, the line would have died in his throat. By withholding the conclusion, he turned a funeral into a riot.
Now bring the device into the present, where it has found a new and faster body. The internet meme is an enthymeme with the words mostly stripped away. A still from a film, a reaction face, a two-panel cartoon: each presents a fragment and trusts the viewer to supply the shared cultural premise that makes it land. The famous shot captioned “one does not simply walk into Mordor” works only if you already carry the premise that the task under discussion is grueling and underestimated. The Drake panels, one option waved off and another approved, state no argument at all; the viewer reads the preference and rebuilds the reasoning behind it. A meme that has to explain itself has already failed, the way a joke dies the instant you gloss the punchline. The shared premise is the whole transaction, and the speed of recognition is the pleasure. We have built, inside the feed, a machine for mass enthymeme moving at the velocity of a thumb scroll, and its persuasive reach dwarfs anything Aristotle could have pictured. The premise a culture will supply without prompting is a precise map of what that culture already believes, which is why the memes a society shares tell you more about its assumptions than its editorials do.
That speed carries the matching danger, multiplied. The demagogue’s favorite instrument has always been the enthymeme, for one reason: it lets him skip saying the indefensible thing out loud while making sure the audience says it to itself. A dog whistle is an enthymeme by design. Its speaker supplies a coded phrase, the target audience supplies the bigoted premise, and the conclusion forms in private where no fact-checker can reach it. Deniability is the structure’s gift to the liar. He can always protest that he never said the ugly part, and he is telling the truth, because he engineered the sentence so that you would say it for him. A society that has lost the habit of asking “what am I being asked to assume here?” has disarmed itself against the maneuver. The defense against a weaponized enthymeme is the boring, unglamorous discipline of dragging the buried premise into the light and looking hard at it. Most people will not bother, which is why the device endures.
For a writer, the practical lesson is to choose the buried premise with care, because that choice is the whole ethical and artistic test. The premise you leave unstated should be one your reader already holds and one you would defend if challenged to say it aloud. Build on a shared truth and the reader meets you halfway, grateful for the room you left. Build on a shared prejudice and you have written propaganda, whatever the subject. The best enthymemes in honest prose tend to suppress the premise the reader is proud to supply, the bit of common decency or common sense that flatters the reader’s intelligence by trusting it. The worst exploit the premise the reader would be ashamed to admit holding. A simple discipline keeps you honest: before you cut a premise from a sentence, say it out loud and ask whether you would put your name to it in plain words. A no answer points the finger straight at the premise itself, which the gap was busy hiding from you as efficiently as it would hide it from your reader.
Twenty-four centuries after Aristotle named it, the enthymeme has not aged a day, and the reason is permanent. Human beings would rather reach a conclusion than receive one. We trust the thoughts that feel like ours, and the surest way to make a thought feel like yours is to let you finish it. The advertiser, the candidate, the trial lawyer, the playwright, and the anonymous teenager building a meme at midnight all work the same ancient vein, offering half an argument and counting on you to mine the rest. The skill cuts both ways, as every sharp instrument does. Learn to build enthymemes and you will write sentences that persuade without hectoring, that respect a reader enough to leave room for the reader’s own mind to move. Learn to spot them and you gain something rarer in a loud age: the power to catch the moment a sentence asks you to believe something it never bothered to say, and to decide, on purpose and with open eyes, whether the buried premise has earned your assent. The argument you finish yourself is the most persuasive argument there is. It is also the one most worth inspecting before you sign your name beneath it.

Reading the Lattice Without the Legend: Grinberg, Syntergy, and the Argument for Real Entry
A scientist walks out of his office in Mexico City on December 8, 1994, and never walks back in. The man is Jacobo Grinberg-Zylberbaum, forty-eight years old, a UNAM-trained neurophysiologist with a doctorate from New York Medical College, the author of a stack of monographs on consciousness, and the last serious researcher to claim that the human brain could be wired into a holographic substrate of reality he called the Lattice. He had spent years measuring electroencephalographic correlations between separated human subjects. Two months before he vanished, he published a paper in *Physics Essays* arguing that pairs of subjects, separated inside semisilent Faraday chambers fourteen and a half meters apart, showed brain activity that mirrored stimulation given to only one of them. Then he was gone. The laboratory was found. Several notes were missing. His wife, who had cause to suspect him of an affair and a documented history of violence, became a person of interest and was never charged. Mexican press cycled through the story for years. [Mystics and conspiracy theorists](https://bolesblogs.com/2026/05/08/the-architecture-of-abandonment-what-the-billionaire-bunker-tells-us-about-the-coming-century/ ) folded the disappearance into the theory, as if the man had stepped sideways into his own hypothesis.
I want to take the legend apart and see what is left.
The Lattice, in Grinberg’s framing, refuses the picture of space that physics offers. Space, in Syntergic Theory, behaves as a high-coherence informational matrix. The brain produces what he called a “neuronal field” that interacts with the Lattice the way a film negative interacts with a beam of light, decoding a hologram. Reality, in this picture, gets read off a substrate that already contains every point in space, every moment in time, and every state of consciousness. The brain becomes one of many possible decoders. High coherence, the kind Grinberg believed he saw in expert meditators and in the Mexican curandera he studied for years (Bárbara Guerrero, known as Pachita), allowed certain brains to interact with the Lattice directly. Telepathy followed from that interaction. Remote viewing came next. Materialization, in the most extreme reading of Pachita’s psychic surgery, sat at the far end of the same continuum.
This is a beautiful theory. It is also, as stated, almost entirely unfalsifiable.
The temptation, when you encounter writing like this, is to either swallow it whole or dismiss it whole. Both responses are lazy. The work has a testable core and a metaphysical shell, and the two need to be separated before anything useful can be said about either.
The testable core is the transferred potential experiment. Two people interact for twenty minutes. They are placed in electromagnetically shielded rooms separated by a distance that rules out ordinary signaling. Only one subject of each pair is stimulated by one hundred light flashes. An EEG records evoked potentials in the stimulated subject. A second EEG records the unstimulated subject. Grinberg and his coauthors, including the theoretical physicist Amit Goswami, claimed that when the stimulated subject showed distinct evoked potentials, the nonstimulated subject showed “transferred potentials” similar to those evoked in the stimulated subject. They titled the 1994 paper “The Einstein-Podolsky-Rosen Paradox in the Brain,” and they proposed that the brain has a macroscopic quantum component capable of nonlocal correlation across distance.
If the effect were real and robust, it would rank among the most important findings in the history of neuroscience. So what does the replication record show?
Leanna Standish and colleagues at Bastyr University and the University of Washington repeated the design in 2003 and 2004, recording simultaneous EEGs from pairs of subjects placed in sound-attenuated rooms separated by ten meters, later extending the work to fMRI. They reported small correlations in some pairs, statistically above chance, broadly consistent with Grinberg’s direction. A 2018 re-analysis by groups at IULM in Milan and the University of Padova, applying machine-learning classifiers to two pooled datasets covering forty-five pairs, found classification accuracies of 50.74 percent on the first dataset and 51.17 percent, 50.45 percent, and 51.91 percent across stimulation conditions on the second. The honest reading of those numbers is that there is, at best, a faint signal above noise, on the order of one to two percent above chance, and that the signal does not hold up under stricter analytical methods. The “one in four pairs” claim from the original paper is the kind of effect size that thins out when sample sizes grow and protocols tighten. The result might be noise. It might be small and real. The data, after thirty years, cannot tell us which.
The Lattice does not announce itself in clean experimental data. What announces itself is a smear of weakly positive results, sensitive to method, sample, and the personal coherence of the experimenters and subjects. A smear of that kind, in any other branch of biology, would be treated as a candidate artifact rather than a candidate discovery.
So where are the weak spots in Grinberg’s argument? I count five.
The first concerns decoherence. Quantum entanglement is fragile. It survives at extremely low temperatures, in highly isolated systems, in laboratories where engineers work for years to prevent contact with the surrounding environment. The human brain operates at 310 Kelvin, immersed in saltwater, packed with thermal vibration and electrochemical traffic. The mainstream physical objection to any macroscopic quantum brain is that entangled states cannot last long enough at body temperature to do anything cognitively useful. Roger Penrose and Stuart Hameroff have proposed microtubules inside neurons as a possible shelter for such states, and that proposal has critics of its own. Grinberg borrowed the language of EPR correlation without supplying a physical mechanism that addresses decoherence at all.
Venue makes a second weakness. *Physics Essays* publishes heterodox work. It is peer-reviewed, but it is not *Physical Review Letters*. Goswami, the coauthor who supplied the quantum framework, is a theoretical physicist whose later career was spent largely outside academic physics, writing for general audiences on consciousness. David Bohm, whose *Wholeness and the Implicate Order* Grinberg cited as foundational, was taken seriously by working physicists in a way that Goswami’s idealist consciousness work has not been. None of this disqualifies Grinberg’s results. It does qualify the weight one should give them before independent replication settles the question.
Pachita is a third problem. Grinberg believed he was watching a high-coherence shaman manipulate the Lattice when he observed the curandera apparently materializing tissue and performing organ transplants without anesthesia. The skeptical literature on psychic surgery is well developed, going back to James Randi’s documentation of Filipino practitioners in the 1970s and 1980s. The techniques are reproducible by stage magicians using animal tissue concealed in the hand. I do not claim that Pachita was fraudulent. I claim that Grinberg’s failure to engage with that literature on his own observations was a methodological gap large enough to fall through.
A fourth weakness sits in the unfalsifiability of the Lattice itself. The transferred potential is testable. The claim that space is a holographic informational matrix decoded by the brain is, as currently stated, not testable in any sharp way. The interpretation can absorb any outcome by adjusting what counts as coherence. A theory closed to refutation has crossed out of science and into philosophy, where Bohm’s implicate order belongs and where Grinberg’s Syntergic Theory should be argued.
The fifth weakness is the disappearance, which has worked as an evidentiary force-multiplier in the opposite direction the mystics imagine. Because the man vanished, the work is treated as forbidden knowledge. Because the work is treated as forbidden, it is shielded from the ordinary correction processes of science. The romance of the vanishing has done more damage to the theory than any single critic ever could.
That is the harsh audit. Here is what survives it.
What survives is a serious twentieth-century researcher who took indigenous practitioners seriously when most of his peers would not, who designed and ran controlled experiments on a phenomenon his discipline refused to study, who published in peer-reviewed venues with a theoretical physicist as coauthor, and whose specific empirical claim of brain-to-brain correlation across electromagnetic shielding has been independently tested by university laboratories in the United States and Europe with weakly positive but unconvincing results. The Lattice as cosmology fails the audit, while the transferred potential as a research program clears it.
Which brings me to the question worth taking seriously. What would real entry into the Lattice look like, if Grinberg’s empirical claim deserves another hearing?
Entry would begin by separating Syntergic cosmology from transferred-potential empiricism, permanently. The cosmology is interesting as a philosophical proposition and belongs in the philosophy of mind, alongside Bohm, Whitehead, and the slow-burning literature on panpsychism. The empiricism is interesting as a falsifiable claim and demands the methodological rigor the original work lacked. That means preregistered protocols, pair samples in the hundreds rather than the dozens, blinded analysis, machine-learning classifiers reported with confidence intervals, datasets shared openly, and a pre-committed null hypothesis the field will accept if the signal fails to clear it. The work has been creeping in that direction for twenty years, slowly, in the parapsychology literature and in a small set of medical schools. It needs to migrate into mainstream cognitive neuroscience or it will live on the margins forever.
Mechanism comes next. Holographic metaphors are not mechanisms. A specific physical proposal must explain how two brains separated by fifteen meters of air and steel could correlate at all. Decoherence is the wall. Until someone proposes a mechanism that survives a hostile physics seminar, the empirical results, even if they hold up, will be read as artifact rather than discovery. Penrose and Hameroff at least attempted a mechanism. Grinberg never did, and the field has not done it for him in the thirty years since.
Last, we would have to give up the romance of the vanishing. Grinberg probably did not step into his own theory. The most likely reading of the available evidence is that he died in late 1994, in circumstances Mexican authorities never resolved, with attention focused on his immediate domestic situation. The investigation failed. The case remains open. As long as his disappearance functions as evidence for his theory, we are doing magical thinking under the cover of physics. A theory has to survive on its experimental record, not on the mystery of its author’s death.
Is any of this real, or possible? The transferred potential, in its weak form, might be real. The Lattice, as Grinberg drew it, is most likely not real in the literal physical sense he intended. What is real is the underlying scandal that consciousness studies were starved of funding and respectability for most of the twentieth century, that a serious researcher who tried to bring rigor to the question was treated as fringe in his own lifetime, that he disappeared before he could finish his work, and that the field has only now begun to catch up to the questions he was asking.
If we want to enter the Lattice, the entry point is methodological, not mystical. We pick up where he left off. The testable parts get tested. Cosmology stands as a working metaphor that may, or may not, be redeemed by data. Above all, we resist the temptation to make the man’s death do the work that his experiments could not finish.
That is the only honest way to read him now.

The Consciousness Trilogy: Reading Three Wagers on the Question We Cannot Settle
This page exists for readers who want a map of the consciousness sequence published on BolesBlogs in the spring of 2026. Three articles, taken together, cover the contemporary terrain on the deepest question philosophy still asks. Each can be read alone. Read in sequence, they form a coordinated treatment of the consciousness problem that points beyond any single solution toward what the field as a whole has and has not accomplished.
The problem itself is older than philosophy as a discipline. We know that we are conscious because we are reading these words and something is happening as we read them. We extend that knowledge to other people, to animals, and possibly to stones, on grounds that work in practice while collapsing in theory. David Chalmers named the difficulty the hard problem of consciousness in his 1995 paper “Facing Up to the Problem of Consciousness,” and the difficulty has not been resolved in the thirty-one years since. Why does any arrangement of physical stuff feel like something from the inside? Why does any neural configuration produce the experience of redness, sourness, dread, or hope? No materialist account has explained this convincingly, and the standard moves to dissolve the question have either denied that consciousness exists in the way we ordinarily mean (illusionism), extended consciousness to every level of organization (panpsychism), or made consciousness the only substrate with matter as its appearance (analytic idealism). The three articles treat each of these alternatives in turn, by way of its strongest contemporary defender.
The first article, [*The Inwardness of Things: McGilchrist, Panpsychism, and the Question We Cannot Settle*](https://bolesblogs.com/2026/05/03/the-inwardness-of-things-mcgilchrist-panpsychism-and-the-question-we-cannot-settle/ ), takes up Iain McGilchrist’s 2021 book *The Matter With Things* and his proposal that matter is one phase of consciousness rather than its source, the way ice and vapor are phases of water. It evaluates his case, with credit for what works and pressure on what fails, and concludes that panpsychism remains a serious option whose central difficulty (the combination problem of how micro-experiences merge into macro-experiences) has not been adequately addressed in McGilchrist’s work or in the panpsychist tradition more broadly.
The second article, [*Consciousness Explained Away: Daniel Dennett’s Illusionism and the Theory That Spends Its Own Foundation*](https://bolesblogs.com/2026/05/04/consciousness-explained-away-daniel-dennetts-illusionism-and-the-theory-that-spends-its-own-foundation/ ), considers Dennett’s lifelong project of arguing that phenomenal consciousness as ordinarily conceived does not exist. It gives Dennett full credit for his demolition of the Cartesian Theater and his contributions to cognitive science, while showing why the central illusionist claim (that consciousness is a user illusion the brain stages for itself) collapses on close inspection because illusions presuppose conscious subjects to whom they appear. Written in the wake of Dennett’s death in April 2024, the piece tries to argue with him at the level of seriousness his work always demanded.
The third article, [*The Dissociated Universe: Bernardo Kastrup’s Analytic Idealism and the Mind That Contains the World*](https://bolesblogs.com/2026/05/05/the-dissociated-universe-bernardo-kastrups-analytic-idealism-and-the-mind-that-contains-the-world/ ), examines Bernardo Kastrup’s claim that reality is mental at base, with individual minds being dissociated alters of universal consciousness, comparable to the alternate personalities that appear in cases of Dissociative Identity Disorder. It presents Kastrup’s strongest moves, including the empirical work on psychedelics, NDEs, and quantum measurement, and tests them against the difficulties his position inherits, including the decombination problem, the contested status of DID as a clinical category, and the challenge of accounting for the resistance the world offers to subjective will. It closes by drawing the three positions together and showing what the trilogy as a whole accomplishes.
Several reading paths are available, depending on what the reader brings to the sequence.
A reader new to philosophy of mind should start with the first article. McGilchrist provides the easiest entry into the territory because his prose is generous and his analogies accessible, and the article’s analysis demonstrates the analytical method that the next two articles will apply to harder cases. Read the second article next for the materialist counter-position, then the third for the closing turn that completes the triangulation.
Readers already familiar with the consciousness debate can take the articles in any order, since each contains a self-contained treatment of its primary subject. The third article’s closing section synthesizes all three positions and may serve as a useful entry point for the impatient reader, who can then proceed to whichever individual article most interests her.
Skeptics of the entire enterprise should start with the second article. Dennett offers the most aggressive case against making the consciousness question a serious metaphysical issue, and the article’s evaluation of why his case nonetheless fails will give the skeptical reader a more accurate sense of why the question persists than any defense of consciousness as fundamental could provide.
Readers of theological or contemplative orientation will find the third article most directly engaged with positions that have been held in non-Western contemplative traditions for thousands of years. Kastrup himself acknowledges the affinity between analytic idealism and Advaita Vedanta, and the article’s treatment of his arguments may help such readers see how a contemporary philosopher with two doctorates and a CERN background defends positions that might otherwise be dismissed as mystical.
What the trilogy as a whole accomplishes is mapping the contemporary terrain in enough detail that a reader can see why the consciousness problem remains genuinely open after three centuries of modern philosophy and two and a half millennia of pre-modern reflection. None of the three thinkers has solved the problem. Each has identified real difficulties in the others. The honest verdict is that the consciousness question may not be solvable by argument alone, and that the next generation of work in this area will need to go beyond the choice among materialism, panpsychism, illusionism, and idealism, and find some way of asking the question that the current frame cannot accommodate.
That said, the trilogy demonstrates what philosophy at its best can do. The standard runs through every article: identify what works, press what fails, name what survives. The discipline involves refusing to settle prematurely and refusing to mystify when settling becomes impossible. Readers who follow the sequence to its end will walk away with sharper questions and fewer false certainties than when they began, which is what serious reading is supposed to do.
A note on the wager metaphor used throughout the trilogy. Each of the three thinkers placed a bet about what consciousness is and what it requires. McGilchrist bet that consciousness reaches all the way down into matter as one of its phases. Dennett bet that consciousness as ordinarily conceived does not exist and that the appearance of inwardness is a user illusion the brain stages for itself. Kastrup bet that consciousness is the only thing there is and that matter is its appearance under conditions of dissociation. Each wager was placed honorably and pursued with rigor. None has paid off in the sense the bettor intended. All three have produced philosophical work that will outlast the lifetimes of those who placed the bets, which is the most honest verdict serious reading can deliver about serious thinkers who have committed themselves to questions that exceed what any single mind can resolve.
The articles run between two thousand seven hundred and three thousand four hundred words each. Each was written for a university-educated audience that respects the difficulty of the question and is willing to follow careful argument to its conclusions. Each is available in its original markdown format. The position taken throughout the trilogy is that getting the question right matters more than choosing a winner among the available answers, and that the best service we can render to the question is to pass it forward in better condition than we found it.
The three articles, in order:
ARTICLE ONE [*The Inwardness of Things: McGilchrist, Panpsychism, and the Question We Cannot Settle*](https://bolesblogs.com/2026/05/03/the-inwardness-of-things-mcgilchrist-panpsychism-and-the-question-we-cannot-settle/ )
ARTICLE TWO [*Consciousness Explained Away: Daniel Dennett’s Illusionism and the Theory That Spends Its Own Foundation*](https://bolesblogs.com/2026/05/04/consciousness-explained-away-daniel-dennetts-illusionism-and-the-theory-that-spends-its-own-foundation/ )
ARTICLE THREE [*The Dissociated Universe: Bernardo Kastrup’s Analytic Idealism and the Mind That Contains the World*](https://bolesblogs.com/2026/05/05/the-dissociated-universe-bernardo-kastrups-analytic-idealism-and-the-mind-that-contains-the-world/ )
Read alone, each article offers a treatment of its primary subject that does not depend on the others. Read together, the three form a synoptic account of where the contemporary consciousness debate stands and why the answers currently available leave the question genuinely open. The reader who completes the sequence will know more about the topography of the problem than most working philosophers do, and will be in a position to evaluate future contributions to the debate with the analytical tools the trilogy has put in place.
That is what philosophy at its best can offer. The trilogy is offered in that spirit.

The Claim I Filed in 2006
This week I published [*The Claimed Body: How American Institutions Divided the Human Organism Among Themselves*](https://BolesBooks.com/ideas/claimed-body ). Fifteen chapters, 559 pages in paperback, 349 in the web edition, a Kindle ebook, and a wraparound cover that took the shape of a parcel map of the body. The book is [out on Amazon and through BolesBooks.com](https://www.amazon.com/dp/B0GXGNMTJS ). Readers who have followed the constellation for any length of time will recognize the argument before they finish the first chapter. I have been writing toward this book since December of 2006, when I first used these pages to ask a question I did not yet have the vocabulary to answer.
The question back then was why the prison kept showing up in parts of American life that were not prisons. A school discipline policy reads like a booking protocol. An employer’s drug screen reads like a parole condition. A hospital discharge summary reads like a court order. The architecture of the panopticon, which Jeremy Bentham proposed in 1791 as a specific building, kept turning up in places where no building existed. In 2008 I registered domains around the word *panopticonic* to hold the argument I was beginning to see, having found only a single prior usage of the word in a 1959 issue of *Time* magazine. The word gave me a handle. It did not yet give me the book.
That book, the first one, arrived last year as [*Carceral Nation: How the Prison Escaped Its Walls and Made a Panopticonic Society*.](https://bolesblogs.com/2026/04/13/carceral-nation-twenty-years-from-blog-post-to-book/ ) *Carceral Nation* did what I had been trying to do for two decades: it named the institutional logic that moved the prison’s discipline out of the prison and into schools, workplaces, clinics, data systems, and the texture of ordinary American life. I thought when I finished *Carceral Nation* that I had written the book the 2006 post wanted to become.
I was wrong. *Carceral Nation* was one half of a pair. *The Claimed Body* is the other half, and the pair is now complete.
Here is how the two books relate. *Carceral Nation* tracks one institution, the prison, and the way its logic escaped its physical walls to operate across institutional domains that were not prisons. *The Claimed Body* reverses the telescope. It tracks one body, the American body, and the way many institutions file claims on portions of it across the life cycle. Not one institution escaping its walls. Many institutions operating on the body simultaneously, each with its own filing mechanism, each with its own jurisdiction, each with its own enforcement apparatus, and no single forum where the body can contest the overlapping and contradictory claims.
The Homestead Act of 1862 is the organizing metaphor. Signed by Lincoln during the Civil War, the Act distributed continental land through a specific mechanism: a settler filed a claim on 160 acres of public land, lived on the parcel for five years, improved it, and received title. The claim, the parcel, the boundary line, the survey marker, the adjudicating court if the claim was contested. Between 1862 and 1976, the United States distributed approximately 270 million acres of continental North America this way. My argument is that the logic of the registered claim did not retire with the Act. It migrated from land to body. A hospital claims your birth. A school claims your developmental measurements. An insurer claims your diagnostic history. An employer claims your labor capacity. The state claims your reproductive eligibility and your military eligibility. If the criminal claim succeeds, a prison holds you. At the other end of life, a dying registry claims your cessation and a funeral corporation claims your remains. Operating in the shadow of all of these, a data broker sells your patterns forward to whoever will pay.
Fifteen chapters because fifteen is the number of major institutional domains that currently hold active claims on the American body. I did not invent the number. I counted the claimants.
What changed between *Carceral Nation* and *The Claimed Body* is the scale of the argument. *Carceral Nation* made its case by tracking one institution across domains. [*The Claimed Body*](https://prairievoice.com/p/filing-a-claim-on-the-rural-body ) makes its case by tracking one body across institutions. A reader who has read both books will see that the carceral logic described in the first is a special case of the claim-filing structure described in the second. The prison is one of fifteen claimants. The book you just finished and the book you are about to start belong to a single continuous argument, rendered from two sides. I needed the first book to get the vocabulary to write the second.
A note on why these books are appearing now, in 2026, rather than ten years ago. The answer is that the data layer has closed. Until recently, the hospital did not know what the pharmacist knew, and the pharmacist did not know what the school knew, and the school did not know what the employer knew. Each institutional claim operated in relative isolation. That is no longer true. The data broker industry, which occupies Chapter 13 of *The Claimed Body* under the heading of the Datafied Body, federates institutional claims into a single behavioral profile that any paying party can access. The body used to be claimed by many institutions operating in isolation. It is now claimed by many institutions operating through a shared back end. That shift, which accelerated across the past ten years and consolidated across the past five, is what made the argument urgent enough to warrant the book now rather than a decade ago.
A second note. I worry that the institutional claim on the American body is tightening at the same moment American democratic capacity to reform institutions is weakening. A claim that cannot be challenged in a public forum, by citizens with political standing, is no longer a claim in the Homestead sense. It is a confiscation. *The Precarious Republic*, the manuscript I continue to work on, argues that American democratic capacity is in measurable decline. *The Claimed Body* documents what that decline looks like from inside a single institutional domain: the domain of bodily life. The two manuscripts are cousins. They are not the same argument. They describe the same condition from different angles.
Readers who have come with me from the December 2006 post through *Carceral Nation* and now to *The Claimed Body*, thank you. The arc took twenty years. It took me the twenty years to learn how to name what I was trying to name. This blog is where the learning happened in public. Every half-formed post, every revision I never ran back, every idea that did not hold up on the second read, was part of the process by which I became able to write these books. Readers who are newer to the constellation, welcome. The books are the consolidated version of what has been going on here all along.
*The Claimed Body* is available now on Amazon in Kindle and paperback, and through BolesBooks.com for direct ordering and for free web reading. A Human Meme podcast episode and a Prairie Voice article accompany the launch. More work follows.
The homestead did not end. It turned inward.
And the claim I filed here in 2006 finally has its title document.
*David Boles has operated the Boles web constellation since 1995. His most recent books are* Carceral Nation *and* The Claimed Body *and* Selling Saturday Morning.

Seeing Around Corners
The phrase “seeing around corners” gets tossed around boardrooms and strategy meetings [as though it were a compliment](https://bolesblogs.com/2008/10/09/you-look-smart-bending-compliments-for-political-gain/ ), a kind of secular beatification for the executive or thinker who got there first. But the phrase deserves closer scrutiny, because what it actually describes is a discipline, and one that most people refuse to practice because the conclusions it produces are uncomfortable.
The spatial metaphor is simple enough. Walking down a city street, you cannot see what waits beyond the next corner. A person who could would hold an obvious tactical advantage, whether the thing around the bend is an opportunity or a threat. When we apply that metaphor to business, politics, or creative life, we are talking about pattern recognition operating at a high level: the ability to read weak signals in the present and extrapolate them into likely futures before those futures become obvious to everyone else.
Andy Grove understood this better than most. When he recognized in the mid-1980s that Intel’s commodity memory chip business was dying, the financial data had not yet made the case undeniable. Competitors in Japan were undercutting prices, margins were thinning, and the trajectory pointed toward irrelevance. Grove asked his colleague Gordon Moore a question that has since become famous in business history: “If we got kicked out and the board brought in a new CEO, what would he do?” The answer was clear. He would get out of memory chips. So Grove and Moore did exactly that, pivoting Intel toward microprocessors and building the foundation for decades of dominance. Grove did not predict the future. He read the present more honestly than his peers were willing to, and then followed the logic to its conclusion.
That distinction matters. Seeing around corners is a discipline of interpretation, not a form of prophecy. Prophecy implies access to information no one else possesses. What Grove had was the same data available to every other semiconductor executive in the industry. The difference was his willingness to accept what the data meant rather than constructing reasons to ignore it. Most strategic failures originate in interpretation, or more precisely, in nerve. The signals were there. The pattern was legible. Someone chose not to read it.
In publishing, the same principle applies with brutal regularity. [The collapse of the traditional bookstore model did not arrive without warning](https://bolesblogs.com/2007/12/28/the-equalization-effect-of-digital-publishing/ ). Independent booksellers had been losing ground to chains for years, and the chains were losing ground to online retail long before Borders filed for bankruptcy in 2011. The warning signs were visible a decade earlier to anyone who cared to look: declining foot traffic, rising real estate costs, a consumer base increasingly habituated to the convenience of clicking rather than browsing. Publishers who saw around that particular corner had time to build direct relationships with readers, to invest in digital infrastructure, to rethink distribution. Those who waited for the crisis to arrive in full view found themselves scrambling with no lead time and fewer options.
Lead time is the currency that seeing around corners produces. The insight itself has limited value if it does not convert into action, and action requires time. Recognizing a collapsing market six months before it collapses gives you six months to prepare. Recognizing it three years out gives you three years to build alternatives, test them, and refine them before the pressure arrives. The earlier the recognition, the wider the range of possible responses. Wait too long and the range narrows to one: react.
This is why the phrase carries an implicit warning whenever someone says it is “important” to see around corners. The word “important” is doing real work in that sentence. It signals that reactive thinking is insufficient for the situation at hand, that the stakes are high enough to demand anticipation rather than response. A doctor who sees around corners catches the early indicators of a disease before it presents with symptoms. A playwright who sees around corners recognizes that audience expectations are shifting before the box office receipts confirm it. In each case, the advantage belongs to the person who treats the present as evidence rather than as a settled condition.
The discipline has a cost, though. Seeing around corners often means arriving at conclusions that no one else shares, and defending those conclusions against people who are emotionally or financially invested in the current arrangement. It also means accepting the risk that your reading of the signals is wrong, that you are abandoning a viable position based on a pattern that never materializes. Grove faced enormous internal resistance when he proposed abandoning memory chips, a product line that had defined Intel since its founding. The resistance was not irrational. People had built careers around that business. Factories were tooled for it. Customers expected it. Telling an organization that the thing it does best is the thing it needs to stop doing requires a tolerance for isolation that most people do not possess, and a willingness to own the consequences if the foresight proves mistaken.
The real question, then, is whether you are willing to act on what you see. Everyone grants that seeing around corners is a useful skill. Fewer people reckon with the fact that the history of failed enterprises is full of leaders who recognized a coming disruption, documented it in internal memos, discussed it in private meetings, and then did nothing because the present was still comfortable enough to justify inaction. Seeing is the first step. Acting on what you see, before the evidence is so overwhelming that everyone else sees it too, is the step that separates foresight from regret.

The Generative Excess: Soul, Dream, and Idea
There are three things you cannot show me. You cannot open your hand and reveal your soul. No technology exists to replay your dream from last night with any fidelity. And no surgeon can extract from your skull the moment a thought first assembled itself into an idea. Each of these phenomena exists, if it exists at all, only as a first-person event, invisible to external observation, resistant to measurement, and stubbornly private. That shared inaccessibility is worth taking seriously, because it suggests that the most important operations of human consciousness happen in a place that science can describe from the outside but never enter.
Start with what each one does. The soul, across most Western and Eastern philosophical traditions, answers the question of continuity. It explains why the person who fell asleep last night and the person who woke this morning are the same agent. Whether you locate it in the [Aristotelian *psyche* as the animating](https://bolesblogs.com/2026/02/20/the-conceit-of-the-clock-aristotle-time-and-the-hunger-that-devours-us/ ) form of a living body, or in the Cartesian *res cogitans* as a thinking substance separate from matter, or in the Hindu *atman* as an eternal self passing through incarnations, the soul functions as the ground of identity. A dream, by contrast, disrupts continuity. You enter a dream stripped of executive function, unable to recognize logical impossibilities, occupying spaces that shift without transition. You become a spectator inside your own mind, watching a performance you did not commission and cannot direct. A waking idea occupies a third position: it is an act of construction, a moment when the mind assembles discrete elements into a new configuration that did not previously exist. Souls persist. Dreams intrude. Ideas emerge.
That tripartite distinction exposes different relationships to volition. You do not choose to have a soul or to lack one; it is either a feature of your ontological situation or it is a fiction, and in neither case does your preference matter. You do not choose to dream, though the content of dreams appears to draw from waking experience in ways that suggest unconscious editorial selection. J. Allan Hobson’s activation-synthesis hypothesis, proposed in 1977, argued that dreams arise when the brainstem sends random electrical signals during REM sleep and the cortex, desperate to impose order on noise, weaves those signals into narrative. If Hobson was even partially correct, dreaming is the brain telling itself stories to explain its own involuntary electrical activity. A waking idea, however, carries at least the sensation of agency. When Archimedes stepped into his bath and recognized the principle of displacement, or when August Kekulé reported seeing the structure of benzene in a half-waking vision of a snake consuming its own tail, the idea arrived with the force of discovery, as though the thinker had earned it through effort.
Both of those famous examples blur the boundary between dreaming and waking thought. Kekulé’s breakthrough came in a hypnagogic state. [Archimedes’ eureka arrived](https://bolesblogs.com/2012/03/05/the-archimedes-heart-screw/ ) during the kind of relaxed, unfocused attention that resembles dream consciousness more than analytical reasoning. Henri Poincaré described the same experience in his 1908 essay on mathematical creativity: after days of failed conscious effort on Fuchsian functions, the solution arrived unbidden while he was boarding a bus, carrying with it an immediate certainty of correctness. The conscious labor had been necessary, but the synthesis itself happened somewhere else, in a cognitive region that shares more architecture with dreaming than with deliberate calculation. This pattern appears so often in the history of science and art that it demands explanation. The waking mind prepares the ground; the sleeping or distracted mind plants the seed; and the idea appears at the border between the two states, as if consciousness needed to look away before it could see.
All three phenomena involve pattern recognition operating below the threshold of awareness. The soul, if we follow the phenomenological line from Edmund Husserl forward, is the unified field of intentionality that makes pattern recognition possible in the first place. It is the subject that does the recognizing, the “I” that precedes every act of perception. Dreams are pattern recognition run wild, freed from sensory constraint and logical discipline, which is why dream content so often features the recombination of familiar elements into unfamiliar arrangements: your childhood kitchen with the ceiling of a cathedral, a conversation with a dead relative conducted in a language neither of you spoke. An idea, when it arrives, typically feels less like construction and more like recognition, as though the pattern was already present and the thinker merely noticed it. That feeling of discovery rather than invention has troubled epistemologists for centuries, because it implies that ideas have an existence independent of the minds that think them, a position that leads straight to Plato and the theory of Forms, where all knowledge is recollection of truths the soul apprehended before birth.
The differences become sharpest when you examine communicability and persistence. An idea, once formed, can be externalized. You can write it down, speak it, encode it in mathematics or music or architecture, and another person can receive it with reasonable fidelity. Euclid’s geometric proofs remain operative twenty-three centuries later. Darwin’s natural selection survived its author by more than a hundred years and shows no sign of weakening. The idea is the one member of this trio that outlives its host. A dream, however, resists translation. Anyone who has tried to recount a dream knows the experience of watching its internal logic evaporate in the telling. The narrative that felt saturated with meaning at 3 a.m. becomes, by breakfast, a string of non-sequiturs that embarrass the teller. Dreams are experiences that degrade upon export; their meaning, if they have meaning, may be inseparable from the neurochemical state that produced them. The soul occupies the most isolated position of all. You can describe your beliefs about the soul, argue for its existence or its absence, construct elaborate theological frameworks around it, but you cannot transmit the thing itself. If the soul is real, it is the most private object in existence, the one possession that cannot be shared, stolen, or photographed.
I want to take a position on truth-value here rather than retreat into academic equivocation. A waking idea can be tested. It can be wrong, and its wrongness can be demonstrated. Kekulé’s benzene ring was either an accurate model of molecular structure or it was a fantasy, and subsequent X-ray crystallography confirmed the model. Ideas submit to verification, and that submission is what gives them their power and their danger. Dreams make no truth claims and therefore cannot be falsified; they operate in a space where contradiction is a feature rather than a defect, where you can be simultaneously yourself and someone else, where gravity applies in one room and not the next. The soul occupies the most precarious epistemic position of the three, because it asserts an enormous truth claim (that personal identity has a metaphysical ground, that you are more than your biology) while offering no mechanism for verification. This is why the soul has migrated over the past four centuries from philosophy into theology: it requires faith in a way that ideas and dreams do not.
Yet there is a way to read all three as expressions of a single underlying capacity. Call it generative excess. A soul posits a self that is more than the sum of its biological processes. Dreams generate entire worlds from stored fragments without any current sensory data. An idea produces a new structure from existing elements that, in their previous arrangement, did not suggest that structure. In each case, something appears that was not contained in its antecedents. The mind, whether sleeping or waking, whether reflecting on its own nature or assembling a new theorem, keeps producing more than its inputs would predict. Whether you call that capacity consciousness, emergence, or grace depends on your commitments, but the surplus is common to all three phenomena. Differences among the three lie in duration, controllability, and communicability. Souls endure, or claim to. Ideas can be transmitted. Dreams do neither, and perhaps that is why, of the three, dreaming remains the most mysterious and the least respected, despite being the one phenomenon whose existence no one disputes.
What holds these three together is the stubborn fact that the human mind refuses to be merely reactive. It insists on generating experience that exceeds what the world hands it. That insistence may be our defining characteristic as a species, and it may also be our greatest vulnerability, because a mind that generates more than it receives is a mind that can deceive itself with its own productions. The soul may be one such self-deception. The dream is a nightly demonstration of how persuasive such deceptions can be. And the idea, when it is wrong, can lead entire civilizations into error. The generative excess gives us Euclid’s geometry and astrology, penicillin and phrenology, cathedral architecture and conspiracy theories. The capacity itself is neutral; what matters is whether we can distinguish its products from its illusions. That question has occupied philosophy since Socrates, and we are no closer to settling it now than we were in Athens. The soul, the dream, and the idea all emerge from the same restless source, and the fact that we cannot see that source directly may be the most important thing about it.
