#SCOTUS 1st decision is FDA v. RJ Reynolds Vapor. 7–2 opinion, Barrett expands co's' ability to challenge FDA regulations of tobacco products in diff circuits—including, here, 5th Circuit.
Sotomayor, Jackson dissent.
Unfortunately, decision affirms the 5th Circuit AND allow many tobacco sellers to forum-shop their cases to the 5th Circuit, where they are nearly guaranteed to win in challenges to FDA regulations. It is wrong on the law, IMO, and bad for public health.
