That's why two purposes of the criminal law are deterrence and incapacitation. <br/><br/>Incapacitation stops the crime from recurring. Deterrence does as well.<br/><br/>If looters were shot on sight as matter of policy, there would be high incapacitation and deterrence, and a high level of maintained peace in the realm, because looting would rarely, if ever occur in the first instance.<br/><br/>The fact it does occur, and regularly, suggests that insufficient "aggression" is being applied.
