My firm does these Title IX cases. An extremely disproportionate number of our clients have been LGBTQ+ people who have had Title IX weaponized against them.

Every time you ratchet up punitive systems, the people who first and most feel the effect are oppressed people.

Danny Rogers was a 5'5" homeless Black man who shoplifted toothpaste. Three guys from the CVS chased him calling him "N***er." Two had knives. They knocked him into a wall, then down to the pavement. Consider an already-sentenced prisoner called into a meeting with cops about some different crime. Most courts, incorrectly IMHO, say the prisoner lives there and it's like being at home, so it is not a "police-dominated atmosphere" & without more (cuffs, etc.) he is obviously free to go so no warnings required. Get real.

None of this is obvious. That's why you need a lawyer. /2

Most vegans who are more than a few years in are pretty quiet about because: (1) all oppression is connected and (2) we don't feel like having "Hitler was a vegetarian" thrown at us and having the conversation devolve from there. If you’re being picked for a jury, you will be told you have to follow the law. That’s true. You have to follow the judge’s instructions. And you can’t lie about it. Don’t do that.

But no one can tell if you did follow the law or if you acquitted because the law was unjust. Why? Because jurors don’t have to tell anyone how they decided the case. More importantly, judges and lawyers are *forbidden* from asking jurors how they decided a case. /3

Jurors acquitted Sean Dunn of assaulting ICE agents with a sandwich. It sure looked like, under the letter of the law, he was guilty. He threw a sandwich. It hit the guy.

But applying that law here was stupid and unjust. So jurors probably did what’s called “jury nullification.” Jurors are the absolute judges of the facts under US law. So if they think the facts don’t justify a conviction, they can vote not guilty and no one can do anything about it. /2

If you’re in an interrogation room, something bad is already happening. The chance that you will talk your way out of it and be let go is far outweighed by the chance that your words will be used to convict you. Demand a lawyer. It will likely result in you being held until you can be brought to court and given a lawyer and a bail hearing. But the pain of even a weekend in jail is FAR outweighed by the pain of years in prison if they convict you using your own words against you. /5

Similarly, if cis white people normalize regularly asserting Miranda rights, one can at least hope that it creates a culture where asserting your rights doesn’t endanger people generally, including marginalized folks.

I learned this lesson as a union electrical worker. We had routes we were supposed to complete in a day. Coworkers took me (the youngun) aside and explained that if I finished a short route too fast or an unreasonably long route in a reasonable amount of time (by rushing) that was bad. A) it’s not physically safe, B) you’ll do a bad job, C) you create unreasonable expectations on your coworkers. This is one reason why unions are good.
