Had a thought about AI models. AI is like lossy compression.
You could probably JPEG compress movie frames at q=0 and make it an art exhibition and claim fair use... but that's not going to fly at q=80.
Similarly, you can train small ML models that achieve specific tasks and make a good case they are fair use or not a derivative work of the training data... but that really doesn't extrapolate to massive GenAI models that memorize large parts of the input or significant components of it.
