As per the provisions, it is not in scope. This is also pretty in line with the poor and late add-ins regarding foundation models.
There is one silver-lining and that is the transient property of *commercial* software: Liability has not been changed and my understanding is that (partly or fully) AI-generated commercial software still subjects the vendor to full liability for the effects of said software.
