On Tuesday, the US Senate passed S. 1837, the Disrupt Explicit Forged Images and Non-Consensual Edits Act of 2025 (DEFIANCE Act of 2025) by unanimous consent. It allows victims of non-consensual, identifiable, deep fake imagery (‘intimate digital forgery’) to sue creators for up to $250,000 plus profits in excess of civil damages.
The action comes in the wake of the Elon Musk-owned tool, Grok, letting X (formerly Twitter) users to create stripped images of women as well as minors. Bloomberg News reported that in one 24-hour period Grok was creating up to 6,700 “sexually suggestive or nudifying” images per hour. X says will ban only those users who create child sexual abuse material (CSAM).
The US Senate passed a DEFIANCE Act in 2024 but it remained stalled in the House. This week’s bill received rare non-partisan support in the Senate. Please ensure that this act has equal non-partisan support in the House and does not remain stalled in 2026.
Tell leadership you want to see this bill brought to the floor for a vote ASAP. And vote yes to passage!
