Story from De Facto Media (independent, BC,
https://www.defactomedia.ca/newsletter/pos/):
An unhoused woman sued the City of Victoria in small claims court over 28 confiscated items.
"Tammy Lynn Cardinal said the items the city took and never returned to her in May 2024 were worth nearly $7,500 and included a prized diamond, a cellphone, power banks, her stove, and $670 in cash.
But on July 29, the [Civil Resolution Tribunal (CRT)] ruled against her, saying she’d failed to prove she owned her possessions with “receipts or pictures” and did not prove that the city employees "acted unreasonably or unlawfully” by seizing her property from Victoria West Park."
Yeah, if the legal standard requires unhoused people to
1. retain records that would satisfy an insurance company in the event of a fire and
2. personally prove to each tribunal member that the practice of government is unreasonable,
probably they won't recover in law.
They'll just keep having to buy items for basic survival with their no money as government officials chase them from the only places they can go and confiscate their stuff in the process. That's legally "reasonable."
(Sometimes government officials give them an indoor place to sit when the weather gets too extreme. Beneficence!)
