Taking a merger's name from an acquired company is valid under rights of ownership. US airlines had several high profile examples. AmericaWest Airlines acquired US Airways out of bankruptcy and took the bigger-sounding name (yet kept the on-air callsign Cactus). They did it again when they acquired American Airlines out of bankruptcy and kept AA's name & callsign. Also when Continental acquired United Airlines out of bankruptcy, they took UA's name but retained Continental's globe logo.
